சிறிலங்க அரசிற்கும் தமிழீழ விடுதலைப் புலிகள் இயக்கத்திற்கும் இடையே நடந்த அமைதிப் பேச்சுவார்த்தை தோல்வியடைந்ததற்கும், தமிழர்களுக்கு எதிராக சிறிலங்க அரசு தொடுத்த இனப் படுகொலைப் போருக்கு இந்தியாவின் மெளன சம்மதமே காரணமென்றும் நார்வே அரசு அமைத்த குழு வெளியிட்ட அறிக்கை கூறுகிறது.

சர்வதேச ஆதரவுடன் இலங்கையில் அமைதி ஏற்படுத்த நார்வே அரசு மேற்கொண்ட முயற்சி தோல்வியடைந்தது ஏன் என்பது பற்றி ஆராய நார்வே அரசு அமைத்த குழு தனது அறிக்கையில் இவ்வாறு கூறியுள்ளது.

நோர்வே அரசின் பணிப்பின் பேரில் தயாரிக்கப்பட்ட 208 பக்கங்களைக் கொண்ட, ‘அமைதியின் பகடைகள்‘ (Pawns of Peace) என்ற தலைப்பிலான இந்த அறிக்கை, நார்வே தலைநகர் ஒஸ்லோவில் நேற்று வெளியிடப்பட்டது.
இந்த அறிக்கையில் சமாதான முயற்சிகள் முறிந்து போக இந்தியா எவ்வாறு காரணமாக இருந்தது என்பது பற்றி பல்வேறு இடங்களில் குறிப்பிடப்பட்டுள்ளது.

2003-2004 ஆண்டுகளில் சமாதான முயற்சிகள் மெதுவாக அவிழத் தொடங்கிய போது கொழும்புக்கும் விடுதலைப் புலிகளுக்கும் இடையிலான பேச்சுக்களை இந்தியா அனுதாபத்துடன் அணுகியதாக இந்த அறிக்கை கூறியுள்ளது.

ஆனால் 2004இல் காங்கிரஸ் கட்சி ஆட்சிக்கு வந்த பின்னர், தமிழர்களின் அபிலாசைகளை பாதுகாப்பதாக கூறிக்கொண்டாலும், மகிந்த ராஜபக்ச அரசாங்கத்தினது இராணுவத் தீர்வு முயற்சிக்கு எதிராக எந்தவொரு அழுத்தமும் இந்தியா கொடுக்கவில்லை என்றும் இந்த அறிக்கையில் கூறப்பட்டுள்ளது.

தனிப்பட்ட சந்திப்புகளில் நோர்வேயை “புலிகளின் நண்பர்“ என்று இந்தியா விமர்சித்ததாகவும், “புலிகளை அவர்களின் இடத்தில் வைக்க வேண்டும்“ என்று கூறியதாகவும் குறிப்பிடப்பட்டுள்ளது.

சிறிலங்கா படைகளுக்கு இந்தியா ரேடர்கள், புலனாய்வுத் தகவல்களை வழங்கியது. சிறிலங்காவுக்கு தாக்குதல் போர்த்தளபாடங்களை வழங்குவதில்லை என்ற கொள்கையை புதுடெல்லி கடைப்பிடித்தாலும், வேறு எவரிடம் இருந்தும் ஆயுதங்களை சிறிலங்கா கொள்வனவு செய்வதற்கு எதிர்ப்புத் தெரிவிக்கவில்லை. விடுதலைப் புலிகள் மீதான இந்திய எதிர்ப்பு நிலைப்பாடு, சிறிலங்காவுக்கு போரை நடத்துவதற்கு உந்துதலாக அமைந்தது.

2004இல் காங்கிரஸ் ஆட்சிக்கு வந்தபோது, விடுதலைப் புலிகளால் தற்கொலைக் குண்டுத் தாக்குதல் மூலம் கொல்லப்பட்ட ராஜிவ்காந்தியின் துணைவியார் சோனியாகாந்தி, இந்தியாவின் சக்திவாய்ந்த நபராக மாறியது திடீர் திருப்பத்தை ஏற்படுத்தியதாகவும் இந்த அறிக்கையில் கூறப்பட்டுள்ளது.

2008 இறுதியில் பொதுமக்களின் இழப்புகளை மட்டுப்படுத்துமாறு புதுடெல்லி கோரிய போதிலும் கூட, இராணுவ நடவடிக்கையைத் தொடர்வதற்கும், விடுதலைப் புலிகளைத் தோற்கடிப்பதற்கும் ஆதரவு வழங்குவதில் இந்திய அரசாங்கம் மிகவும் தெளிவாக இருந்தது.

விடுதலைப் புலிகளின் இறுதி நாட்கள் பற்றி குறிப்பிடும் இந்த அறிக்கையில், புலிகள் மிக நெருக்கமாக சுற்றிவளைக்கப்பட்ட நிலையில், விடுதலைப் புலிகள் சரணடைவதற்கு கொழும்பு மிகக் குறைந்தளவு ஆர்வமே காட்டியது. போரின் இறுதியில் விடுதலைப் புலிகள் தப்பித்துக் கொள்வதற்கு இந்தியா ஆர்வம் காட்டியிருக்குமா என்பது சந்தேகமாகவே இருந்தது.

சமாதான முயற்சிகளில் இந்தியா கூடுதல் பங்கு வகிக்குமாறு 2007இல் நோர்வே தொடர்ச்சியாக வலியுறுத்திய போதும் புதுடெல்லி அதை நிராகரித்து விட்டது. இராணுவ நடவடிக்கைகள் தீவிரமடைந்த போது தாக்குதலை நிறுத்துமாறு இந்தியா அழுத்தம் கொடுக்கப் போவதில்லை என்பதும் தெளிவாகியது.

போரின் இறுதிக்கட்டத்தில் இந்தியாவில் நடந்த பொதுத்தேர்தல் குறித்து சிறிலங்கா கவலை கொண்டிருந்தது. காங்கிரஸ் கட்சி தூக்கியெறியப்பட்டு வேறு யாரும் பதவிக்கு வந்தால் புலிகளுக்கு உதவி கிடைக்கலாம் என்ற கவலை சிறிலங்காவுக்கு இருந்ததாகவும் இந்த அறிக்கையில் கூறப்பட்டுள்ளது.

இந்திய மத்திய அமைச்சர் ப.சிதம்பரம் போரின் இறுதிக்கட்டத்தில் புலிகளின் தலைவர் பிரபாகரனுடன் தொடர்பு கொண்டு, முன்வரைவு அறிக்கையை ஏற்று ஆயுதங்களை கீழே போட இணங்குமாறு ஆலோசனை கூறியதாகவும், ஆனால் இந்த நகர்வு புலிகள் ஆதரவு அரசியல்வாதியான வைகோவுக்கு கசிந்ததும், இது காங்கிரசின் தந்திரம் என்று நிராகரிக்குமாறும், தேர்தலில் பாரதீய ஜனதா கட்சி ஆட்சியைப் பிடிக்கும் என்றும் புலிகளை மீட்கும் என்றும் அவர் உறுதி கூறியதாகவும் அறிக்கையில் கூறப்பட்டுள்ளது.

நார்வே அரசின் அதிகாரப்பூர்வ ஆய்வுக் குழு வெளியிட்டுள்ள இந்த அறிக்கை இலங்கையில் தமிழர் அழித்தொழிக்கப்பட்டதில் இந்திய அரசு வகித்த பங்கு ஆதாரத்துடன் விளக்கப்பட்டுள்ளது குறிப்பிடத்தக்கது.

Former Sri Lankan President denounces current government
The latest revelations on Channel 4 News came after the former president of Sri Lanka condemned the current government in a speech in Colombo. Chandrika Kumaratunga warned that the country could descend into anarchy following the civil war between the govenment and Tamil rebels. Speaking in Colombo, Mrs Kumaratunga said her children had reacted with 'shock and horror' to Channel 4's 'Killing Fields' documentary which alleged war-time atrocities. "My 28 year-old son called me, sobbing on the phone to say how ashamed he was to call himself a Sinhalese and a Lankan," she said. Mrs Kumaratunga served as President of Sri Lanka from 1994 to 2005. She is the country's only female President to date.Kumaratunga suffered permanent nerve damage and lost vision in her right eye following an assassination attempt by the Tamil Tigers at her final election rally in Colombo in 1999.

Taking part in a meeting organized by a London based Tamil media association in Southall in London on Saturday, celebrated writer Arundhati Roy termed the war on Eezham Tamils in the island of Sri Lanka as genocide that was allowed to happen by the world. "The most horrific things I have seen and testimonies I have read are from Sri Lanka," she said. Ms. Roy, known for championing the cause of the Aathivaasis (indigenous tribes), emphasized how similar sorts of patterns of annihilation were taking place in India too. "There is a whole universe of fractured morality between what people say and what people do. As the Indian military, and platoons and platoons of policemen are displacing the Aathivaasis in the back of everyone's mind are the graves of Tamils in Sri Lanka," she said.

"When I visited Sri Lanka, it horrified me to see how everything had closed over that war." She observed how in all the celebration of the booming economy, "there was a deep silence over what happened."

The meet was organised by International Association of Tamil Journalists (IATJ) in London.

Roy also spoke on how the West found "moral reasons" to attack few regimes, and why certain "war crimes" were acceptable whereas others were not. She also lamented the manner in which the Sri Lankan model of genocide was inspirational to other states in the region. "Other governments are looking at the Government of Sri Lanka and thinking, if not talking: If they have done it, why can't we”, Roy said.

She also pointed out that while people have the right to resort to arms, one should also look into what are the values of the people who have picked up arms. When somebody does that [resort to armed resistance], they are also responsible for what happened to the Tamil people.

"The most horrific things I have seen and testimonies I have read are from Sri Lanka" she said and expressed her angst over how the Sri Lankan state forces targeted hospitals, and bombed people after forcing them to move into a No Fire Zone. "The world allowed this to happen, and it will continue to allow this to happen" she said.

While Roy suggested that she was "somebody who believed in the diversity of resistances" she also spoke about the need to ask serious questions about violent resistance. She said it was strategically important to ask, "What went wrong." She asked, "Was it the concentration of power in too few hands."

"There is no point into looking for condemnation or sympathy—because it is merely lip service," she said. Speaking of the need to enter a process of introspection, Roy said, "It is not just life that has been destroyed, but also a form of resistance."

She attacked mainstream Tamil politicians in Tamil Nadu who have made their careers talking about Eelam. She labelled their concern as "rubbish" and said that they had done little beyond whipping up hollow identity and cashing it. She spoke of how Eezham Tamil refugees in Tamil Nadu were "treated like animals", and of the hardship they had to face on a daily basis. "I have visited those camps and it is a terrible sight to see," she said and contrasted how the normally vociferous Tamil politicians were silent on the plight of the refugees.

Responding to questions from the audience, she charmed them with her sharp insight on resistance struggles and expressed sympathy to the sufferings undergone by Eezham Tamils. She shared the experience of struggle for self-determination in Kashmir, Manipur and Nagaland, and also the struggle against big dams and against corporate take-overs of forests.

Eezham liberation is geopolitical priority for Tamil Nadu:

If the people of Tamil Nadu are vigilant enough of the nature and aims of the geopolitical forces operate in the region, then they will realise that call for independence of Eezham Tamils should get priority over war crimes investigation and indictment of Mahinda Rajapaksa, said Mr. Thirumurukan Gandhi of the May 17 Movement of Tamil Nadu, while discussing the UN report in Chennai last month. The whole world, except Tamil Nadu, knows that the power to change the paradigm lies in Tamil Nadu, he further said. Thirumurukan’s analysis coming from grassroot thinking in Tamil Nadu was refreshing, while ‘analysis groups’ in Chennai and some international organizations backed by establishments aiming to capitalize the war crimes to their interests truncate the ultimate justice of liberation to the affected, said political observers in the island and in the diaspora.

Geopolitical analysis or regional political analysis of quality was rarely made from Tamil perspectives in Tamil Nadu in the past. Such analyses were always a monopoly of a so-called ‘national’ minded clan and their media in India.

Much of the sufferings of Tamils in India and outside, and the diplomatic woes of India in its southern flank were due to this lacuna, as analyses coming from Tamil Nadu perspectives meeting the rigours of international norms were never highlighted or they didn’t come at all, rising above the din of empty political rhetoric.

The way a new genre of Tamil analysts discussed the UN panel report last month in Chennai was very refreshing, amazingly transparent in the content of truth and casts away conventional analyses or psy-ops coming from enslaved universities, funded organizations and intelligence-operated strategic ‘think tanks’ into dustbin, commented an academic in Jaffna.

The most dangerous of the ‘analysis campaign’ after the genocidal war in Vanni is shedding crocodile tears for the war crimes to get political acceptance to post-war agendas, but refusing to examine why the affected should not be liberated and independent.

If successive constitutions since British times and post-British times have failed for more than a hundred years on the national question in the island, and if the logical end has reached the point of genocide, then there is no point in accusing the implementation of the present constitution or harping on constitutional reforms. There is something wrong with the very existence of this state as a single unit.

When the very word ‘Sri Lanka,’ ever since its constitutional inception, is associated with a genocidal state, anyone with common sense could tell why the Tamils can’t be ‘Sri Lankans’ in the island. Saying, “Tamils can be Sri Lankans” at this stage is only another way of putting an agenda to exterminate the nation of Eezham Tamils in the island.

Why don’t the political science pundits who always think of power interests tell us what global or civilization-benefits are there for humanity by Eezham Tamils not claiming their independence even when they face genocide, the academic in Jaffna asked.

Raman and Hariharan have lost the credibility with the war ending in genocide. So, there will be another set of analysts with seemingly new paradigms but with the old agenda, the academic further said.

The investigation on war crimes, covering all those who were involved with the crimes, is a responsibility of world humanity primarily for its own sake, if it wants progress from the suffocating state and power system of today. Even after becoming two states the Eezham Tamils and the Sinhalese have to strike reconciliation on their own, for their own survival in one island. But anyone concerned with war crimes or reconciliation today cannot pretend ignorance that neither a genuine war-crimes investigation nor genuine reconciliation is possible when the Eezham Tamils don’t have independence first.

The responsibility of Tamil Nadu, based on Tamil perspectives, which Tamil Nadu alone could do, is more than identifying itself with the global responsibility of war crimes investigation. The government of Ms. Jayalalitha may have taken carefully calculated initial steps in the right direction, but it should not be deviated by vicious forces that have a record of doing mischief in the region is the concern of global Tamils.

Thirumurukan Gandhi, K. Aiyanathan, Prof Paul Newman, Devasahayam, Rajendra Chozhan, Priya Thampi, Arul Ezhilan, Pandimadevi and DSS Mani, who have discussed the UN panel report in Thiyagaraya Nagar, Chennai on May 28, have boldly and explicitly brought out the intriguing aspects that affect affairs from moving in the right direction and what Tamil Nadu should do about them.

Such analyses should also reach the outside world for the benefit of global public opinion, the Jaffna academic commented, adding that with such quality of awakening and new thinking, the next generation of Tamil Nadu cannot be taken for a ride or be contained by anyone, without yielding into aspirations that are righteous.

Thirumurukan Gandhi

There was genocide before the war and there is genocide after the war. Before there was a militant organization to counter it, now there is nobody. The genocide that takes place after the war needs our full attention.

Tamil Nadu should be aware of its geopolitical importance to take right moves, while the land of Tamils is fast becoming another Afghanistan in South Asia.

China that sets the String of Pearls and aspire for Blue-water Navy and the USA that now orchestrates regime changes to save its image and to control Chinese inroads are not really against each other. They only practice containment and in the process people perish.

Ilangkai (Sri Lanka) is in the highlight now as it is going to set the trend elsewhere. The next in line is the Karen nation in Burma.

The US and the EU broke the peace talks in the island. The US knows all what had happened during the war. There was close understanding between the US and the Rajapaksa regime and the US gave arms to Colombo through Israel.

The US needs the entire east coast of Sri Lanka.

Corruption is a weapon to bring in instability and corruption is encouraged to bring in instability. Corruption cannot be the cause for revolution but revolution can have corruption.

The popular uprisings in the world, including the Jasmine Revolution in West Asia and North Africa are planned and hijacked by the US, only to change the leaders and to escape the anti-US sentiments in the world.

They prepared Rajapaksa to destroy the LTTE. After the LTTE, Rajapaksa is not needed and the powers now bring in the war crimes investigation to ‘punish’ him. Rajapaksa is not our concern, but Tamil Eelam is our concern. Our fear is whether Tamils will get their justice. The US is known for differentiating punishment to the ‘criminal’ from delivery of justice to the victim.

The political replacement that took place in Tamil Nadu is analogous. They need some one acceptable in Tamil Nadu to endorse their agenda.

All except Tamils know that Tamil Nadu is the key factor.

The West may now hand over the task of ‘political solution’ to India. As it does now and then, India will dust the 13th Amendment.

There are three Tamil entities to handle.

The Tamil National Alliance (TNA) in the island will be handled both by India and the USA.

Whatever they impose in the island should find endorsement in Tamil Nadu. As Karunanidhi has lost the credibility there should be some one else who could evoke hopes in Tamil Nadu. Tamils need to be watchful. Tamil Nadu has already gone into global politics.

When the Tamil Nadu State Government is handled, there will be no one to raise voice in the Assembly.

The Communist Party of India (CPI) may talk, but it too looks at the issue within the framework of a ‘united Sri Lanka’.

Vaiko was purposefully sidelined earlier and now, as there shouldn’t exist anyone within the Assembly to raise the name Tamil Eelam.

The third entity, the diaspora and its committed section, is already pressurised heavily in many systematic ways in the West. When the stage is set, Rudrakumaran will be forced to accept what is set by the agenda.

When the BBC and the CNN blare out the virtues of the solution, the voices in Tamil Nadu will be feeble.

Our support to the war crimes investigation of the UN should be conditional. The UN panel report is incomplete, as it has not recognized the genocide in the island. Merely a regime change effected by the war crimes investigation cannot bring in lasting solutions to Eezham Tamils.

2,50,000 Tamils have been killed in the war of decades. Accepting wanting solutions is not doing justice to the killed.

We live in historic times.

Like SJV Chelvanayagam was firm in 1976 in Vaddukkoaddai Resolution calling for Tamil Eelam, like Pirapaharan was firm in 1987 against hoodwink solutions, Tamil Nadu has to be firm now.

The war crimes the UN now speaks of, is not an isolated event. The root has to be addressed and answered. Governments in India and Sri Lanka always set the agenda and we in Tamil Nadu only respond to passing events of the agenda. Immersed in immediate issues we fail to raise the voice for the fundamental issue – the independence of Tamil Eelam.

Eezham Tamils have democratically mandated the Vaddukkoaddai Resolution and have re-mandated it in the diaspora recently.

War crimes investigation may be welcomed. But, without the recognition of the genocide and without the recognition that a national question was the reason, the investigation is meaningless.

Let those who don’t agree conduct a referendum through the UN and see.

Tamils throughout the world, including those in Malaysia, will be holding special prayers tomorrow to the mark the second anniversary of the killing of 40,000 civilians by the Sri Lankan army.

This occurred during the savage final onslaught by government troops against the Liberation Tigers of Tamil Eelam (LTTE) fighters on May 18, 2009 in Mullivaikal in the north east of Sri Lanka.

Called Mullivaikal Thinam (Mullivaikal Day), local organising committee chairman S Pathi urged Malaysians to attend the prayers in support of families of those killed by the army.

He said about 500 people are expected to attend the prayers at the Girl Guides Hall in Jalan Sultan Abdul Samad, Brickfields at 8pm tomorrow.

“We want to show our solidarity with family members of those killed during the conflict and to the people of Sri Lanka that we care for them,” said Pathi.

He added that currently there were about 4,000 Tamil Sri Lankans registered with the UNHCR here and several local NGOs are assisting these refugees with basic supplies of food and temporary shelters.

On May 18, 2009, Sri Lanka forces declared victory over LTTE and in their savage onslaught of Mullivaikal, ignored the civilian population numbering in the thousands in the area.

Sri Lankan troops forced these Tamil civilians into a narrow strip of land on the North-eastern coast and indiscriminately bombarded the area using heavy weaponry.

The Sri Lankan government declared ‘no-fire zones’ on three different occasions, urging civilians to seek shelter there and then continued their bombardment of these “safe zones”.

Sri Lankan soldiers also fired artillery that directly struck or landed near hospitals on many occasions. Up till today over 146,000 Tamils are unaccounted for.

United Nations just published publicly a scathing war crimes accountability report just hours ago.

The UN has published a 10-month long investigative report concluding with a call to initiate an independent investigation into war crimes and crimes against humanity in Sri Lanka. The report is about 200 pages with evidence detailing mass rape of women and mass killings of Tamil civilians by the Sri Lankan government.

Amnesty International Calls on Sri Lankan Government to Act on Enforced Disappearance

(Washington, DC) On the eve of the one year anniversary of the disappearance of Sri Lanka human rights defender Pattani Razeek, Amnesty International renews its call for the Sri Lankan government to ensure those responsible for his abduction are brought to justice.

"We understand the person who has been identified as a suspect has a close association with a government official,” said Yolanda Foster, Amnesty International’s Sri Lanka expert. “The government must show it will not tolerate abuses of power and ensure those responsible for Pattani Razeek’s enforced disappearance, irrespective of rank and status, are brought to justice.”

Amnesty International is calling on the Sri Lankan government to:

· Immediately investigate and disclose the fate and whereabouts of Pattani Razeek, who went missing on February 11, 2010, and immediately inform his family;

· Ensure that if he is detained by the authorities, that he is immediately removed to an official place of detention with access to a lawyer, his family and the courts; and that he is immediately released unless he is charged with an internationally recognizable offense and is remanded by an independent court;

· Establish responsibility for the disappearance of Pattani Razeek and ensure that those responsible for Pattani Razeek’s enforced disappearance, irrespective of rank and status, are brought to justice in proceedings which meet international standards of fairness.

Pattani Razeek disappeared on February 11, 2010 in the town of Polonnaruwa, in Sri Lanka's North Central Province. Police in Puttalam identified but failed to question the man they consider the prime suspect in Razeek’s enforced disappearance, a former colleague of Razeek, and a close associate of Sri Lanka’s Minister for Industry and Commerce. According to a police report, the suspect placed phone calls using Pattani Razeek's cellular phone SIM card following his disappearance. The suspect remains at large and has applied for anticipatory bail.

Mr. Razeek is a well known human rights defender. At the time of his disappearance, he was the Managing Trustee of the Community Trust Fund (CTF), a Sri Lankan NGO based in the town of Puttalam in North Western Province. In February 2010 he was returning from a visit with colleagues when their vehicle was intercepted by a white van. Pattani Razeek approached the men in the other vehicle, and they exchanged greetings in Arabic. He returned to his CTF colleagues and said he would join the group in the white van, which according to him was headed for Valaichchenai, a town in Eastern Province. He assured his colleagues that he would meet up with them later. However, they did not see him again, and he never returned home.

Following his disappearance, his family received several ransom demands from Razeek’s alleged captors, but the callers did not follow through.

A simultaneous smear campaign against Razeek in the form of leaflets and rumors suggesting that his disappearance was linked to either political or personal activities appeared which we are concerned is aimed at discouraging human rights advocacy on his behalf. A public statement by S. R. M. M. Irshad, Parliamentary Secretary to Minister Rishad Bathiudeen following Mr. Razeek’s disappearance claimed that Razeek had been detained by the Secretary of Defense because he had acted as an intermediary to transfer funds to the LTTE.

Sri Lanka Tamil killings 'ordered from the top' - Kill every body

May 19, 2010 — A senior Sri Lankan Army commander and frontline soldier have told Britains Channel 4 News that point-blank executions of Tamils at the end of the civil war in May 2009 were carried out under orders from the top. In an extended segment on Sri Lanka Tuesday, Channel 4 broadcast translated video interviews with the two soldiers. Surrendering LTTE fighters and their families were detained, tortured and shot, the trooper said. Channel 4 also interviewed in the studio the former Chief Prosecutor for the International Criminal Tribunals for the former Yugoslavia and for Rwanda, Louis Arbour, who slammed the impunity enjoyed by Sri Lankan forces throughout the armed conflict. Sri Lankas ambassador to the United Nations, Palitha Kohana, failed to show up, despite agreeing beforehand to appear to defend his governments record.

The senior Sri Lankan army commander said: "I don't think we wanted to keep any hardcore elements, so they were done away with. It is clear that such orders were, in fact, received from the top."

"Definitely, the order would have been to kill everybody and finish them off, he said. It is clear such orders would have been received from the top.

Tthe Sri Lankan trooper said: Our commander ordered us to kill everyone. We killed everyone.

He confirmed he killed civilians. Surrendering LTTE fighters and their families were detained and tortured before being shot, the soldier also said.

Channel 4 News broadcast several photographs taken by soldiers from the killing fields in Northeastern Sri Lanka, showing piles of bodies, lines of corpses and terrified civilians. Some of the bodies had their hands tied behind their backs.

The program quoted soldiers as saying LTTE leader Pirapaharans thirteen year old son had also been shot dead after surrendering with his bodyguards.

Speaking on the Channel 4s flagship news program at 7pm, Louis Arbour said there was no possibility of Sri Lanka holding a proper inquiry into the war crimes, noting that since the conflict began there had been impunity.

She questioned the viability of the Sri Lankan government investigating the conduct of its own armed forces.

A senior Amnesty International official told Channel 4 News his organisation had this week launched a world-wide campaign to highlight the need for an independent international investigation into war crimes in Sri Lanka.

London-based Amnesty International and New York-based Human Rights Watch have joined Brussels-based International Crisis Group in this regard, Channel 4 said.

This week International Crisis Group, of which Arbour is currently head, released a detailed account of the mass slaughter during the final months of the conflict last year. The report said the scale of death was much higher than reported at the time, and certainly high enough to triple the UNs internal figure of 7,000.

Noting that both the LTTE and the Sri Lankan armed forces were responsible for war crimes, the report made clear that all but a small portion of these deaths were due to government fire

Eventually, an independent and impartial survey of those still living in the Northern Province will be needed to establish this part of Sri Lankas history, ICG said.

On Monday night Arbour told an audience at Chatham House the foreign policy think tank that "the [Sri Lankan] government's refusal to distinguish between combatants and non-combatants" and the "sheer magnitude of civilian death and suffering" dealt what she called "the most serious of body blows to international humanitarian law".

Despite Channel 4 desperately trying to locate him, Sri Lankas ambassador to the United Nations, Palitha Kohana, failed to show up, despite agreeing beforehand to appear to defend his governments record, news anchor Jon Snow said.

Sri Lankas London High Commission meanwhile issued a statement totally denying the allegations of war crimes.

The High Commission of Sri Lanka in the United Kingdom totally deny the allegations made against the Government of Sri Lanka and its armed forces. As it has been repeatedly stressed and supported by evidence, Governments security forces were engaged in a humanitarian operation with the objective of rescuing the civilians held as human shields by a terrorist outfit: the LTTE, which was banned in many countries including the UK, the statement said.

All internationally accepted standards and norms of such operations were followed in the prosecution of the humanitarian operation by the security forces which were under strict orders to follow a zero civilian casualty policy.

Australian Tamil referendum attracts media, provokes Colombo's envoy

More than 10,000 registered to cast their votes in the referendum across Australia last weekend, on the creation of independent Tamil homeland in Sri Lanka, reported SBS Australia, citing organisers.

John Dowd, the president of the International Commission of Jurists in Australia, SBS said, citing him saying that the referendum highlighted the aspirations as well as the plight of Tamils in the island of Sri Lanka.

The spokesperson of the Australian Tamil Congress Dr. Sam Pari called for a UN led referendum in the North-East to ascertain the Tamils opinion on the creation of an independent Tamil homeland.

Australia is the 10th country, but the first in the eastern hemisphere to conduct the referendum on the creation of independent and sovereign Tamil Eelam, the main principle of the Vaddukkoaddai Resolution of 1976.

The polls in several countries have delivered a resounding 'yes', the SBS observed in a lengthy coverage of the referendum in its World News.

Esteemed guests and dear friends...

We have come together to open up a discussion on the 'Unspoken Genocide' in SriLanka. First I would like to thank the organizers for opening up such a discussion for the first time in the country. They have put forth great effort to break the silence of this country on SriLankan ethnic crisis and the worst Genocide of our times. This effort by the student community raises question on our responsibilities. They have made the first move. We are to follow. It is indeed high time to break our silence and the silence of the country and discuss, decide and act upon the issue.

The Permanent People's Tribunal on SriLanka held at Dublin has come with a report which clearly states that the SriLankan Government has committed war crimes and crimes against humanity in its bloody war against the Tamils of the country.
Friends, how does that concern us? Or rather, I would ask, how is it more concerned to us, than the war crimes committed by the US in Afghanistan and Iraq?
There are two important reasons. One, it is concerned to us, because what SriLanka has done to the Tamils there, is what India may do to suppress the nationalistic and socialistic struggles in India.

SriLanka has presented a model genocide... a model which has successfully massacred hundreds of thousands of civilians without any witness. A war without witness is what SriLanka has presented before the world as a model. This model has now given strength to the rest of the oppressing governments of the world and shown ways of how to oppress in a more brutal way without having to worry about international or national criticisms. This model can very well be executed by India in Kashmir or the Punjab or the North East or in the 'Red corridor'. Name it 'War against terror' or 'War for peace' and execute anything brutal. Nobody will question you.
I say this because, SriLanka did not invade any other country or people. It launched the brutal attack on its own civilians... its own citizens, in the name of 'war for peace'. Yes peace in the form of graveyard. A clear act of Genocide.
United Nations defines Genocide as the "The systematic and widespread extermination or attempted extermination of an entire national, racial, religious, or ethnic group."

Genocide does not only mean killing. And the SriLankan Government did not only take the lives away. The Genocide against the Tamils in SriLanka did not start very recently. It has been systematically implemented in various forms from time to time. It is that systematic implementation which reached its peak in 2009.
When dealing with war crimes, the international community is focusing only on a few of the issues, especially at the end of Eelam War 4, at Mullivaaykkaal in May 2009.
But, there have been an ongoing record of grave breaches of the Geneva Conventions of 12 August 1949, for a long time in the island of Sri Lanka and the pattern of this long record has to be analysed by anyone investigating the War Crimes.
My view is that the War Crimes, carried out by the Sri Lankan military with direct and indirect help from various actors of the international community, are part of a systematic programme and should also be investigated for the context of the patterns rather than singled-out events.

It is also equally important to understand that a systematic and prolonged genocide doesn't take place without a deep mythology behind it.

Like the hatred against the Jews in Europe throughout many years had resulted in the Holocaust, which led to the Genocide Convention, we also see clear evidences of a racial mythology originating from the Buddhist chronicle of Mahavamsa in the island of Sri Lanka. The only difference is that while the Jews have been migrants in Europe, the Tamils of SriLanka are the indigenous people of the island who have been living there from pre-historic times. The fact is that it is the Sinhalese who are settlers. While this historic fact is accepted in the Mahavamsa, the epic on the other hand preaches hatred against the Tamils. The Sinhala politicians have systematically promoted this Mahavamasa mindset for a long time and have turned the Sri Lankan state into a unitary Sinhala Buddhist state. The dangerous dimensions of the racism caused by the Mahavamsa mindset, which attacks the Tamil people who cherish secular values, should be objectively analysed by the investigators.

It is very important to look at the racial motives behind the Sinhala state and its infrastructure, from the way how racism is being fed to the Sinhala children in its education system and to how the Sri Lankan military has been a racist oriented military.

A structural analysis should be an important part of the investigations, if the investigation should become meaningful for all the victims of the past and the future.

I only present my observations, which are symptoms of the underlying trend, to which we have been a witness for a long time.

The Tamil people in North and East of the island of Sri Lanka always fled towards LTTE controlled areas since the Sri Lankan armed forces launched their military offensive violating the February 2002 Ceasefire Agreement.

What took place in Vakarai of Batticaloa, Moothoor East of Trincomalee, Musali of Mannar and various settlements in the Vanni region are evidences of the crime how people were chased, uprooted and forced to flee, from place to place, in a systematic and planned way.

Many people from Vanni who have sought refuge in Tamil Nadu tell us stories of having undergone displacements more than 20 times within the Vanni region alone, each time seeking safety within the LTTE controlled area. They could have fled towards Sri Lanka Army controlled areas, but they didn't. They viewed LTTE administered de-facto state of Tamil Eelam as their homeland and took a stand, to be there as it was clearly their political will.

The term IDP, which stands for internally displaced persons, is a wrong one to be applied to most of the Tamils, who have gone through several displacements. They are not simply 'displaced' for a temporary period, but were constantly driven through waves of displacements in such a way they lose everything and end up finally without anything, totally uprooted. They are not IDPs but an Uprooted People.
Bringing the war to the places of civilian population, against their will, is a crime against humanity.

Attacks on civilian safety zones, resulting in the massacre of children and women and deliberate starvation resulting in malnutrition are clear signs of not only war crimes, but also ethnic cleansing and genocide, as these are acts of deliberate and systematic destruction of a racial, political, or cultural group, against its collective will.

There have been systematic attacks on ambulances inside Vanni for a long time. There has been a systematic campaign of air-raid with massive attacks on civilian centres. All this has to be looked in a perspective of a long time pattern.
For a long time, the Tamils in the South were living in constant fear. But, now the remaining Tamils in Vanni and other places have been incarcerated, stripped of every personal possession, and become subjugated. They are subjected to psychological genocide.

The Sri Lankan military has taken over even their right to re-settle and re-construct their livelihood. The Sri Lankan military is carrying out the so-called development, to which Colombo is seeking funds from the international community. They are subjected to structural genocide.

This "development" is being carried out with the agenda of settling Sinhalese in traditional Tamil lands. This act of terrible proportion is demographic genocide. This demographic genocide has been going on for decades.

From the Sinhala Only policy, destruction of Jaffna Library and the attack on International Tamil Conference, there has been a continuous record of cultural genocide in the island.

Tamils who reach Tamil Nadu report deliberate annihilation of cultural heritage. They tell stories of many Buddisht shrines being built all over the Tamil homeland. The names of the Tamil villages and roads are being changed to Sinhala.
What is going on in several places along the coasts of Vanni now is cultural genocide combined with demographic genocide.

Even before the armed conflict, there were systematic state-sponsored pogroms in 1956, 1958, 1961, 1974, 1977, 1977 and that of large genocidal proportions in 1983, which is remembered as the Black July by Tamils.

There have been no investigations of international proportion on these crimes against humanity and genocide.

If the world bodies had addressed the visible symptoms of these pogroms at an early stage, the Tamils would not have been forced into an armed resistance.

The UN in its International Covenant on Civil and Political Rights 1966 says quite clearly in Article One that “All peoples have the right of self determination”. Most importantly Government of Sri Lanka is a party to this Covenant and hence is bound by its own treaty.

Based on the UN’s definition of Self-determination, many nations were provided with the right of Self-determination. Very recently 2 nations, East Timor and Montenegro were provided the right of Self-Determination based on a referendum. In East Timor 74.85% of the people voted in favor of Self-Determination. In Montenegro, only 55% voted in favor of Self-Determination. Yet the UN recognized their right to Self-Determination.

But the people of Tamil Eelam have been opting for Self-Determination from as early as 1977 and have been voting in favor of the same. In the 1977 elections, when the TULF contested the election with a single point manifesto, stating to achieve Self-Determination of Tamils through a separate Tamil Nation, out of the 19 seats 18 seats were won by them, which accounts to more than 90% people in favor of Self-Determination.

In 1983, during the Local bodies election, the Liberation Tigers of Tamil Eelam called for the people to boycott the election, on the line of Self-Determination. At that period, LTTE was just one of the five militant movements fighting for Self-Determination, and the smallest. Even then the people accepted the call and 95% of them boycotted the election.

In 2004 Parliamentary elections, the Tamil National Alliance (TNA), comprising of 4 Tamil Political parties, viz., TELO, EPRLF, TULF and SLTC, contested the election stating that they accept the leadership of LTTE in the struggle of Self-Determination for Tamils in the form of separate Tamil Nation. TNA won 22 of the total 23 seats. Here again the result indicates that more than 90% voted in favor of Self-Determination. Not only in the areas under the control of LTTE, but also in Jaffna, which is under Government Control, 90.65% of votes were polled in favor of TNA.

In 2005 Presidential Elections, LTTE called for boycott and more than 95% boycotted the election. In Jaffna, which was under Government Control the polling was only 1.21%.

Hence, not once, but in 4 elections, the Tamil people have expressed their consent for Self-Determination. That too every time it was more than 90%. When UN can recognize East Timor with 74.85% and Montenegro with just 55% why can’t it recognize Tamil Eelam with more than 90% for 4 times?

While the Tamils have been continuously expressing their will for Self-Determination through all possible ways, the Sinhalese was using various political tactics to undermine the Tamils.

Not a single pact entered into by Sinhalese was respected by them. Not only the pacts entered into with Tamil Leaders like the Dudley-Chelva and Chelva-Banda pacts, also the pacts entered into with another country or with the mediation of another country were broken by the Sinhala Governments. In 1987, India represented by its Prime Minister Rajiv Gandhi, entered into an agreement with SriLanka represented by its President Jayawardane. This agreement had various clauses which included merging the northern and eastern provinces and withdrawal of military forces from educational institutions and places of worship. The LTTE respecting the agreement, surrendered its arms. But on the Sinhalese side, the military was not withdrawn.

LTTE commander Dileepan undertook fast unto death stressing the Indian Government to implement the clauses of the agreement. But India let Dileepan die. Yes friends.. coming from a militant organization, Dileepan did not fight with India with arms. He followed the path of the Father of Indian Nation, Gandhi, and undertook fast unto death. But India did not respect his struggle. Gandhi’s country let a young man die on fasting. After 12 days of fasting without even a single drop of water, Dileepan gave up his last breath.

Recently, the Sinhalese made the merger of Northern and Eastern Provinces unlawful through a court verdict. The only clause remaining in the Indo-SriLankan agreement was also thrashed.

On February 22 2002, SriLanka entered into an agreement with LTTE in the presence of Norway in Oslo. The main clauses of the agreement were to withdraw the military from social buildings. The Military had occupied 156 school buildings in Tamil areas. Also, in 144 schools, stating that the buildings were un safe, the military had restrained the schools from functioning in the buildings and hence those schools were functioning under the trees. Further military had occupied places of worship like churches and Hindu temples. Added to that they had occupied houses and residential places too. The Oslo agreement was that the military be withdrawn from Schools and places of worship in 160 days, from houses in 30 days and from other residential areas in 60 days. Further the agreement was that Tamils are to be allowed fishing in the sea in 90 days. But none of these were done.

It is this level of respect does the Sinhalese give to international community and international laws. It is this same Sinhalese Government which now says that it maintains the camps with international standards. The Sinhalese Government has always been unruly, uncontrolled by any of the International standards, rules and regulations.

Now with more than 3 Lakh people detained in concentration camps with their movements arrested, without proper food, education and other basic needs, the SriLankan Government is planning to produce a new generation of Tamils, without any capability, without the will to freedom, without any progressive thinking, without the fighting spirit, with their minds totally occupied on worries about their day to day life.

As Dublin Tribunal's report rightly puts it, is this not a crime against humanity? Is it not essential to prosecute SriLanka on these charges under International law? I feel this as highly essential for the future of humanity.

Yes my dear friends.. the world has come to such a state that there is urgency for each one of us to join hands to save humanity. What we saw in Afghanistan, what we saw in Iraq has now come very close to us. We could sense it just beneath our feet. My dear friends.. it will not be too long for us to experience it ourselves.
I am not exaggerating. It is a fact. In Afghanistan and Iraq it was mighty US which executed the crime against humanity. But in this tiny country called SriLanka, it wasn’t any big power from outside. Neither is SriLanka a powerful nation politically, geographically or economically. But such a weak country like SriLanka, could very openly execute genocide on its own people, what bigger danger could befall on humanity?

The Second reason on why this brutality of SriLanka is more concerned to us as 'Indians', is because, our hands are soaked in that blood. It's our tax that went as arms and ammunition to commit those war crimes. It is with our money and in our soil, that those SriLankan military officials who committed the war crimes were given training.

One could say, how can India be responsible just because it sold arms and provided training? You may add up saying that how can India control the affairs of another country. This was what the Indian high commands were saying all through. Even the Dublin report, which talks about the role of Western countries hasn't said anything about India.

I want to take you back in history to find an answer for this question. In 1983, there was a dreadful pogrom against the Tamils in the SriLankan Capital Colombo. Thousands of Tamil civilians were killed. Lakhs of them fled to the Northern and Eastern part of SriLanka which is their traditional homeland. The pogrom was spreading all over the country.

It was at this stage that the then Indian Prime Minister Indira Gandhi said in her address to the nation on August 15, 1983, that India will not keep quiet if such atrocities against Tamils would continue. It was after this statement of the Indian Prime Minister that the state sponsored pogroms came to an end.

This is just an example of how India can take control of the situation in another country. Today Indian Government is biased and prejudiced towards Tamils of SriLanka. The media with all its vigor stands by the Indian Government in its bias and prejudice. And the people of India trust the media and are influenced by the media to take a prejudiced stand.

I can explain on how media stood on the wrong side.

From the day the war broke up, Tamils in SriLanka were uprooted. They had to restrict themselves to a limited space. In the course of the war, this limited space shrunk and became even more limited. From January, reports started pouring in on heavy casualties. Hundreds of thousands of people were clinging to each other in a very small area. And SriLankan Army, Air force and Navy were using heavy weapons, artilleries, cluster bombs, phosphorus bombs and other chemical weapons and what not, on the places where Tamils were dense. Dublin report confirms the use of these banned weapons and clearly states that the targets were the Civilian population. Dublin report also says that hospitals, schools and other civilian building were bombed. People were dying in hundreds everyday. As per the Dublin report which in turn quotes the internal documents of the UN, almost 217 people were dying everyday. None of these appeared in the Indian media. There wasn't even a slightest quote. But on May 19th.. Indian media was completely filled with SriLankan news. The news that LTTE leader Prabhakaran was dead. Some media even projected as if the whole war was to kill him and now SriLankan Government has won. The Indian media was literally rejoicing on the victory of the SriLankan Government.

Even while publishing/telecasting this news, Indian media didn't care to mention about the death of hundreds of thousands of the Tamil civilians. And post-war, newspapers like Hindu write that Tamils are now kept in golden cages. According to them, the IDP camps, which are actually concentration camps, are paradise on earth. And for the rest of the media, only thing that drew their attention in the whole episode was the news of Prabhakaran's death.

Is this only because of lack of information? Surely not! It's something else.
The media not only closed its eyes towards the war in SriLanka, but also when Indians were killed by the SriLankan Navy. Yes. From early 1980s, more than 300 TamilNadu fishermen were killed by the SriLankan Navy. Thousands have been abducted and tortured by them. The whereabouts of many such abducted fishermen are not known for years. Their families are in dismay as to whether their loved ones are alive or not. This is continuing even today, though the SriLankan Government has declared that the so-called ‘war against terrorism’ is over. Aren’t the TamilNadu fishermen Indians? Isn’t the Indian Government with its Navy responsible for their safety? Aren’t the Indian media and Indian politicians concerned about a foreign navy crossing our borders and killing our people? If the Indian fishermen are abducted or arrested by the Pakistan Navy, it becomes a national issue. But even if the SriLankan Navy kills Indian fishermen its nothing. Its still a mystery why this has never been an issue. Legally speaking, the TamilNadu Government and the Indian Government have all the legal rights to sue the SriLankan Navy under war crimes for its brutality against TamilNadu fishermen.

As an added evidence on how the Indian Government is prejudiced and biased with regards to SriLankan Tamils I would like to bring to your notice the plight of the SriLankan refugees in India, concentrated in Tamil Nadu. There has been flow of refugees from SriLanka from time to time. During early and the mid 80s the flow was very high. Those people who came here then are still in India. Most of them live in the Government sponsored refugee camps located in various parts of the state. Few others live outside the camps along with the local people. Apart from these two categories there is one another, which is the worst of all. I will come to that later.

In 2007, a team of law college students did a comparative study of the SriLankan Refugee camps with that of Tibetian refugee camps. The result once again exhibited how biased the governments are when it comes to SriLankan Tamils. The SriLankan Refugee camps in India are no less than the IDP camps in SriLanka. Very poor living conditions with no proper sanitary systems or medical aid. We can even keep that aside. But the restrictions imposed on them are something which raises doubt on whether we are in a democratic nation or not. They are not allowed to possess mobile phones. No free movement outside the camps. There is no proper medical aid provided inside the camps. Hence if anybody is sick they need to go outside the camp to get treatment. But even for this they need to obtain permission. They are given very meager amount as daily compensation. While the Tibetian refugees are given around Rs. 5000 per family for a month, the SriLankan refugees are given an incomparable amount. The man of the house with Rs. 144, lady of the house with Rs. 100, other adult members with Rs. 90 and children with Rs. 25. Hence a family with a man, wife, one elderly person and 2 children will get around Rs. 384 per month. Can you imagine? 5 people living with Rs. 384 per month. It is good to know that the Tibetian refugees are treated in a better way. Our question is just why are the SriLankan refugees not treated in the similar manner. The SriLankan refugees, unable to live with the compensation provided, try to find jobs for daily wages. But even for that, they ought to get police permission and are sent outside the camp for such jobs only for 3 days in a week. SriLankan Tamils, by nature, give more importance to education. But that has become the major crisis. They need to study in the government schools in the nearby locality. For higher education, till 2003, special reservation was provided for the refugees. But now it has been revoked. Hence professional education is just a dream. They cannot enroll as advocates. They cannot buy land or vehicles. Land at least is understandable. But vehicles? Even those who would like to earn their living as taxi drivers cannot do that since they cannot buy a vehicle. Not even two-wheelers. They have been kept in these living conditions for more than 25 years. And it is not all. The worst is yet to come.

As I mentioned earlier, there is one another category called 'Special camps'. As and when the refugees arrive by sea at Rameshwaram, the coastal town closer in sea route to SriLanka, men and women are separated and interrogated. Of that, youth are once again separated and taken away by the Tamil Nadu Police intelligent wing, the 'Q' branch police. The Q branch police say that the youth are separated to find if they are militarily trained. It is at the will and wish of the Q branch to decide on whom to be freed to the camps and whom to retain. If any person resists, or even shows a slightest gesture of resistance, then the family has to forget that person. They are taken away for more intensive interrogation and then they are branded as militants and are kept in 'Special camps'. Apart from those directly from the refugee camps, others who are arrested outside the camps on various charges, even if they have a valid passport and visa, they are detained in these Special Camps.

These 'Special Camps' were initially constituted in 1990, in Vellore. The Tippu Mahal and the Hyder Mahal were used for this purpose. Of the two, one was told to be for militants and the other for supporters, who were not directly members of the movements. These supporters were detained with their family. As such there were 150 detainees in the militant camp and 200 in the supporter's camp.

On 1993 May 14, an additional camp was constituted in Chengalpet, which is around 50Kms from Chennai. Actually it was the Chengalpet Sub-jail which was converted into the camp. Only militants were detained in this camp.

Friends, these 'Special camps' are nothing but illegal prisons under the control of the Tamil Nadu Intelligence. It doesn't come under the Prison department or the local governing authorities. It is completely controlled by the Q branch police. As soon as one enters the 'Special camp', all his documents including his passport, educational certificates etc are taken away from them. This is the lock that the Q branch puts on them. Hence, in order to get back their documents safely the people have to abide by whatever the Q branch police say. False cases are implicated on them. But no trials are conducted. Even if they are not remanded or convicted by the court, the Q branch says that till the case is over they ought to remain in the Special camps. Even if the court grants bail to them, they are brought directly from the prison to these Special camps. Charge sheets are never filed in the cases implicated on them. This means that they have no idea to finish the case. The worst is, even those who are released by the court, are not sent out but kept in these Special camps. In Rajiv Gandhi murder case, of the 19 acquitted by the Supreme Court, 9 were SriLankan citizens. But from the very gates of the prisons, the Q branch took custody of them and took them to the Special camps. This was not under any legal grounds. Only after they agreed to go back to SriLanka or any relative of them made arrangements to take them to a foreign country, they were released from the Special camps, taken directly to the airport and sent out.

Imagine, how many will have the opportunity to go abroad. And they have come from SriLanka to India only because their lives are at risk in SriLanka. Then how can they go back? Is it humane to send them back?

We have filed cases against these illegal prisons. But the cases are still pending in the courts.

The inmates and many human rights and social organizations have been continuously fighting for the closure of these illegal prisons. The inmates of the Chengalpet camp undertook fasting requesting, not for their release, but to conduct trails and finish the cases pending on them quickly. But they were brutally attacked by the police. All their belongings were broken. Many were badly hurt. The human rights organizations, students and various other politically and socially concerned organizations like ours, took up the issue and agitated in support of the detainees.
Even after all this, the Government in December 2008, constituted yet another camp in Poonamallee. The specially constructed prison to detain the accused of the Rajiv Gandhi murder case was used for this purpose. This Special prison was termed as a high security prison and after those accused in Rajiv Gandhi case were moved to other prisons, the Muslim youth arrested in the Coimbatore Bomb blast case and in various cases all over the state were detained there. Now this prison is used as a Special Camp.

By the end of 2008, there were 97 detainees altogether. After continuous agitations and hunger strikes, some were released and now there are 34 detainees. Of these 34, 5 have no cases or charges against them. They were released on all cases one and a half years back. But still they are detained. 10 of them are detained for more than 2 years since charge sheet has not yet been filed on them and the case is pending in the court without trial. 4 of them are severely sick but are detained without any proper treatment.

Apart from this, there are a number of Indian Tamils who are implicated on various cases on the charge that they helped LTTE in various ways. As you may all remember, in 2002, POTA was used in Tamil Nadu to arrest people who lent verbal support to LTTE. Similar cases still prevail, though not under POTA, but under various other sections of CRPC and the Unlawful Activities Prevention Act. And these cases too are dragged without trial. There are number of people in prisons for years together as under-trial prisoners. And many others are walking to courts for more than a decade. I am standing example for them. I was arrested twice in NSA and once in TADA. The TADA case was framed in May 1994. I was released in bail in January 1995. From then on for the past 15 years I have been traveling once in a month to the court which is more than 200 kms away from my place, only to get the case adjourned. The case is pending since the argument was not heard for about 7 years. More than 5 judges have changed. And each time a new judge comes in everything is started afresh. One other person Mr. Rajan who was also arrested in this case was not given bail for 9 years. The tragedy is that even if he is convicted on the charges against him, the maximum punishment could be only 5 years.

This shows how the Tamil Nadu State Government and the Indian Government are highly prejudiced against the ethnic problem in SriLanka. They did not approach the issue with concern. Rather they used it to intimidate the Human Rights and social activists.

Hence it is clear that the Indian Government is with the SriLankan Government in its Genocide against Tamils.

Friends, I come from Tamil Nadu. We the people of Tamil Nadu are more emotionally bound with the issue, not only because we share an ethnic relationship with the Tamils of SriLanka.

But mainly because we have more close-up shots of the issue. In the past 30+ years, each family in Tamil Nadu has an acquaintance with at least one or more SriLankan Tamil. We have heard their plight, their life, their history and their struggle in their own voice. We know their pain not from the media but through personal conversations. We understand their struggle for a life with self-esteem through self-determination for their homeland.

And we are completely convinced that theirs is a struggle for freedom and not terrorism. It is because of this that, all sectors of people in Tamil Nadu raised their voice to stop the war. Political parties, Social organizations, laborers, trans-gender community, physically challenged, Film industry, Students, advocates, IT professionals.. not a single sector was staying away. Each one of them showed their concern and protest in whatever mean was possible for them.

A resolution was passed in the State Assembly. But … none of these appeared in the National Media. And other than us, nobody else from any part of the country uttered a word except for a few but strong words of concern from the intelligentsia.

This hurt us a lot my friends. Leave alone the media. Leave alone the Government and the political parties. But the social movements, human rights organizations and activists and the intelligentsia of the country.. their silence has what hurt us a lot. Our voices were not heard. And we lost more than 1 Lakh people in a few months.
And that is why I said, our hands are soaked in blood.

We are still not out of the shock. We are still mourning. And ... the Bollywood is getting ready to conduct its biggest event of the year in Colombo. I really do not understand this psychology. The tribals in Chattisgarh are killed by the army. The women in Manipur are raped by the Indian army. The youth in Kashmir disappear. But the country continues to lead its life with rejoice. I do not expect them to mourn with us. But not even a single word is uttered in concern. Where do we lag in making the people in other parts of the country understand our emotion. Our feelings. Our concern.

While thinking of what happened to our fellow Tamils in SriLanka, sometimes we feel that the whole country has betrayed us. All the time we feel guilty that even though we are part of such a big and powerful nation, we weren't able to save our fellow people. Not only that the Government we elected did not heed to our feelings and stop the war.. but on the contrary.. stood on the opposite side and helped the SriLankan Government to kill those people for whom we were crying aloud. We were totally helpless. How can we ever face them anymore?

One old woman who was in the war zone till the last day of the war, then in the camps and has now come to India.. I happened to meet her. She has lost her son. She has experienced things that we could not even imagine or understand. She has walked over dead bodies to save her life. At this old age.. she had to literally run. Till the day I met her, she hadn't come out of the shock. Of course we cannot expect her to come out so soon. She explained me all her experiences with no tear in her eyes. No shake in her voice. Even when she spoke about her son, she said it in a plain tone. But my friends, you know when she broke down? 'We were waiting for India to come to our rescue. Our only hope was with India. But India too betrayed us' and with that she broke down to tears. Imagine how guilty I would have felt sitting before her.

This guilt is what is killing us today. We want to do something. At least for those people remaining alive. Not just for their livelihood, but for their freedom, their dignity and their self-esteem.

The Dublin report has come as a beacon in the darkness, which befell on us in May 2009. I use this opportunity to thank the Permanent Peoples Tribunal (PPT) that found the Sri Lankan government as guilty of war crimes, crimes against humanity and that the International Community, particularly the UK and USA, share responsibility for the breakdown of the peace process and that the charge of genocide requires further investigation.

While also thanking the Irish Forum for Peace in SriLanka which hosted the Tribunal, we look upon with gratitude, Justice VR Krishnaiyer, Justice Rajindar Sachar, Ms. Arundati Roy who have come forward and contributed in support of the Dublin Tribunal against the war crimes committed by the SriLankan Government. This gives us great hopes for the future. We are now strengthened with your support.

With that in mind, I would like to put forth the following requests to the esteemed guests who have gathered here with concern.

One, the International Community has a responsibility to address the war crimes, crimes against humanity and the investigation on genocide in correct context, not failing in its duty in prevailing upon the Sri Lankan state for all its war crimes, crimes against humanity and genocide, and ensuring that the justice for these continuous crimes is translated into a meaningful political solution, satisfying the aspirations of the Eelam Tamil Nation.

Secondly, is regarding the IDP camps in SriLanka. The Indian Government said in June that the SriLankan Government had given assurance that it will re-settle all the people in the IDP camps within 6 months. But it almost a year and the IDP camps still exists. The people in the initial IDP camps are separated into groups and moved to different camps. They are not re-settled in their native places. It is reported that Sinhalese settlements are done in full swing in the Tamils' traditional home land. I request you to urge the Indian Government and in turn the SriLankan Government to ensure that all Tamils are re-settled in their own home lands.

Number three, the Human Rights watch in its report released on February 1 2010 says that more than 11,000 people are detained in SriLanka as LTTE suspects. The government contends that the 11,000 detainees are former fighters or supporters of the LTTE. The 30 page report of the Human Rights Watch states right in its title as 'The uncertain fate of LTTE suspects'. As such, the Government refuses to release details on where these detainees are kept and in what condition they are. This has left their families in anguish and agony. Hence, the SriLankan Government should be urged to release details on the whereabouts of these detainees and allow their family members to meet them. Further emphasis should be made to treat these detainees as prisoners of war, thus securing them under the International laws on Prisoners of war.

4. As regards to the situation prevailing in Tamil Nadu as to the conditions of the SriLankan Tamil refugees, the Tamil Nadu Government should be urged to provide better living conditions for the refugees. While the Special Camps are to be closed permanently, the Normal camps are to be inspected periodically by a committee of independent individuals like doctors, human rights activists, lawyers and such renowned citizens.

5. The Indian Government or the Tamil Nadu Government should execute its legal rights and sue the SriLankan Navy for entering the Indian borders in an unauthorized manner and killing the Tamil Nadu fishermen.

As a final request, once again I request each and every one of you to join hands to save humanity from State terrorisms.

Gotabhaya Rajapaksa, the Sri Lankan defence secretary and the brother of the SL president, in an exclusive interview to the BBC on Tuesday, opposed any international investigation on war crimes during the final stage of the war. Meanwhile, the official news website of the Rajapaksa government in its Sinhala and versions has blamed external forces for rejuvenating the claim of Tamil Eelam by backing Sarath Fonseka, citing the pattern of the results of the recent presidential elections. The Sri Lankan President Mahinda Rajapaksa also warned the politicians not to guide the 'innocent people' in 'wrong path', while he referred to the election participation in North and East in his Tamil version of the February 04 speech.

Gotabhaya Rajapaksa became visibly irritated responding to the question posed by BBC's Asia Today on Tuesday:

"Any international entity can ask for any investigation. There will be no investigations in this country. I will oppose any body, who is trying to do [investigations], because there is no reason [for investigations].

"The real thing we have to do is to bring this country, develop this country, bring peace to the country, reconciliation, by bringing out all these [war crime] things ... will not.

"These are the people who [...] have other motives, asking [for investigations]. Whether it is United Nations or any other country, we are not - I am not - allowing any investigations in this country. There is no reason. Nothing wrong happened in this country. Take it from me. There will be no investigations for anything in this country. I will not allow [it]. That is not what public wants. That is not what this country wants.

"Don't ask anything about any investigation. Don't talk to me [on] any investigation. There will be no investigations in this country. Take it from me. I am the Secretary of Defence and I will oppose anybody who want to have these things. I will not [allow] anything [like it]. This is my final word."

In the meantime, Sri Lankan president Mahinda Rajapaksa in his Tamil version of the February 04 address delivered from Kandy, warned the politicians not to lead innocent people in wrong ways, while he referred to the conduct of presidential elections in the North and East.

In his "Indpendent Day" address, Mr. Rajapaksa went on record once again saying that there is no minority in his country. "All those who love the mother of Ilangkai (Sri Lanka) are the people of this country. Don't betray your homeland," he said in Tamil.

"We will resolve our problems within us by talks, all people will have the same facilities, that is equality, that is equal rights. One country, one people and one justice," Rajapaksa proclaimed.

In the meantime, Colombo government's official news website news.lk compared the election results illustrating the voting pattern with the map of Tamil Eelam and stating that the pattern revealed separatist agenda. The news was published in Sinhala and Tamil versions.

DUBLIN TRIBUNAL FINDS AGAINST SRI LANKA ON CHARGES OF WAR CRIMES

Dublin judges panelIn Dublin today at 2:00 p.m. the Peoples Tribunal chairman Francois Houtart read the preliminary findings of the Peoples Tribunal on the war in Sri Lanka and its aftermath. There are 4 findings:

That the Sri Lankan Government is guilty of war crimes
That the Sri Lankan Government is guilty of crimes against humanity
That the charge of genocide requires further investigation
That the International Community, particularly the UK and USA, share responsibility for the breakdown of the peace process.

Harrowing evidence including video footage was submitted by eye witnesses of the use of heavy artillery and phosphorous munitions, and of the continuous violation of human rights by military activity to a panel of 10 international jurors over two days.

Irish members of the jury were Denis Halliday and Mary Lawlor.

The Irish Forum for Peace in Sri Lanka welcomed the preliminary findings of the tribunal. Responding to the findings the forum issued the following five demands:
We call on the Sri Lankan Government to allow the UN to conduct an inquiry into war crimes and crimes against humanity perpetrated during the final stages of the war between the Sri Lankan Armed Forces and the LTTE, and during the war's aftermath.
We call on the Sri Lankan Government to release all those being detained in concentration camps and the estimated 11,000 people being held secretly at unknown locations.
We call on the Sri Lankan Government to end the use of extra-judicial killings, sexual violence and the deprivation of food and water as weapons against a civilian populatiion.

We call on the Sri Lankan Government to end the suppression of political dissent by violence or other means.

We call on the Sri Lnkan Government to fully implement human rights for all citizens of Sri Lanka and a political solution involving the full participation of the Tamil population, ending the systematic historical discriminatory measures of the Sri Lankan state against the Tamil people.

The Irish Forum for Peace in Sri Lanka asserts that long term peace and stability can only be established on the basis of full justice and rights for all the inhabitants of the island.

More than laying sound democratic foundations to the liberation struggle, the referendum will be deciding how the free Eezham Tamils and their descendants choose to identify themselves to the world – whether as ‘Sri Lankans’ or as Eezham Tamils, in the wake of international attempts to impose identity on them, commented Tamil circles in Canada on the on going referendum Saturday. Meanwhile, volunteers who worked for the referendum in France, especially the younger generation, shared their thoughts with TamilNet in a video interview.

By stating the Tamil aspirations democratically and in no uncertain terms, the referendum fills in the political vacuum of Eezham Tamils in the aftermath of war, says T. Thiruchchothy, a member of the formation committee of the Eezham Tamil country council for France, called 'The House of Tamil Eelam'. "We are now able to assess the pulse of our people to decide the future course of our politics, he further said.

International politicians as well as the public are not aware that majority of Eezham Tamils want Tamil Eelam. They are under an illusion that the Tamil Eelam struggle is only an agenda of Tamil militancy. They were sceptical whether small nations like that of Eezham Tamils need a political solution at all. We felt that it is our duty to demonstrate the truth and then we are now satisfied that we were able to convince them through our democratic exercise, says Kirushanthi Sakthithasan (Shalini) a medical student in the organising committee.

Speaking on follow-up she said that the formation committee is also working on establishing an all party group supporting Tamils among French and European Union parliamentarians, who will uphold the democratic will expressed by our people in such referenda throughout the world.

Akalya Aloysius, a marketing management student attributed the success of the referendum to the participation of youth. "We have been working on this for a couple of months, making door-to-door campaign, meeting parents and experimenting novel ways to attract youth participation. A stage came when youth and their parents were fully convinced in engaging in this social duty. We now realise that everything is ultimately in our hands. We, especially the younger generation, has to work for ourselves. We think even Tamil Eelam can be achieved by us if our generation is really determined about it," Akalya said.

When asked about financial support for this massive democratic exercise such as a countrywide referendum, N. Pratheepkumar, another young generation member of the formation committee of the country council said that they were fully depending on mass participation and contribution. For instance, in the case of referendum, he said that they started with nothing, but were able to meet the expenses through volunteering, in some cases full-time volunteering and through sponsorships.

ஆரம்பத்தில் போராட்டத்தின் பின் தளமாக தமிழ்நாடு இருந்தபோது தமிழ்நாட்டில் ஒரு மருத்துவப் போராளியாக செயற்பட்ட அவர் பின்னர் களத்திற்கும், தளத்திற்குமிடையே தேசியத் தலைவர் அவர்களுக்கான இணைப்புச் செயற்பாட்டாளராக செயற்பட்டதன் மூலமாக அவரது ஆளுமை அன்றே தேசியத் தலைவர் அவர்களால் இனங்காணப்பட்டுள்ளதுடன் முதன்மை யானதாகவுமிருந்துள்ளது.

பிரிகேடியரின் விடுதலைப் பணியை ஒருகால ஒழுங்கில் நோக்கும்போது அமைப்பில் இணைந்து அரசியல்துறைப் பொறுப்பாளராக பொறுப்பேற்ற 1984 ஆம் ஆண்டிலிருந்து 1993 ஆம் ஆண்டு காலப்பகுதி வரையிலான அவரது முதன்மையான படைத்துறை ரீதியிலான செயற்பாட்டையும் 1993 இலிருந்து அவர் வீரச்சாவடைந்த 2007 வரையான காலத்தையும் இரு கூறுகளாக நோக்கலாம்.

ஏனெனில் 1984 ஆம் ஆண்டிலிருந்து 1993 ஆம் ஆண்டு வரையான காலத்தில் படைத்துறை ரீதியாக தமிழீழ விடுதலைப் போராட்டத்தில் மிக முக்கியமான ஒரு காலகட்டத்தில் செயற்பட்டுள்ளார். இக்காலப்பகுதியிலேயே தமிழீழ விடுதலைப் போராட்ட வரலாற்றில் முக்கியத்துவம் மிக்க இந்திய ஆக்கிரமிப்புக் கெதிரான இந்திய – புலிகள் போர் நடைபெற்றது.

இந்திய – புலிகள் போரில் அவர் தென்மராட்சி கோட்டத்தின் தளபதியாக நின்று இந்திய இராணுவம் வெளியேறும் வரை சமராடியுள்ளார்.

இந்திய ஆக்கிரமிப்புப் படைகளுக்கு எதிராக அக்காலத்தில் அவர் ஒரு வீரம் செறிந்த போரை நடாத்தியுள்ளதுடன் இன்று அவரோடு கூடவே நின்று களத்தில் போராடிய போராளிகள், தளபதிகள் நினைவு கூருகின்ற வகையில் தலைமையோடு அவருக்கான தொடர்பு துண்டிக்கப்பட்ட நிலையிலும் எந்தவித சிக்கலுமின்றி போராளிகளை வழி நடாத்தியமை எந்தவொரு சூழ்நிலையிலும் திறமையாக படை நடத்தும் அவரது திறனை வெளிப்படுத்துகின்றது.

அத்தோடு இக்காலப்பகுதியில் குறைந்தளவு போராளிகளையும், குறைந்தளவு ஆயுத தளவாடங்களையும் கொண்டு இந்தியப் படைகளுக்கு எதிராகப் பல்வேறு தாக்குதல்களை வெற்றிகரமாக மேற்கொண்டதுடன் பின்னர் தலைமையோடு தொடர்பினை ஏற்படுத்தியதன் மூலம் ஒரு வரலாற்று நெருக்கடிமிக்க காலத்தில் சிறப்பாகச் செயற்பட்டுள்ளார்.

உண்மையில் ஒரு சிகரெட்டைப் புகைத்து முடிப்பதற்குள் புலிகளை அழித்து விடுதலைப் போரை முடிவுக்குக் கொண்டுவர முடியும் என்ற இந்திய அரசின் எண்ணத்திற்கு யாழ்ப்பாணத்திற்குள் நின்றபடி இந்தியப் படை வெளியேறும் வரை புலிகள் குறித்த இந்திய அரசின் கணிப்பீடுகளையும் அனுமானங்களையும் பொய்த்துப்போக வைத்த புலிகள் இயக்கத்தின் திறனில் பிரிகேடியரின் பங்கு அளப்பரியது.

இதேவேளை பிரிகேடியரின் இரண்டாவது கட்ட (படைத்துறை ரீதியிலான) செயற்பாட்டில் 1991 ஆம் ஆண்டுக் காலப்பகுதியில் யாழ். மாவட்ட சிறப்புத் தளபதியாக பொறுப்பேற்றுச் செயற்பட்ட காலம் முதன்மை பெறுகிறது.

இக்காலப்பகுதி மிக முக்கியமான ஒரு காலப்பகுதியாகும். இக்காலப் பகுதியிலேயே, முதலில் ஒரு கெரில்லா இயக்கமாக இனங்காணப்பட்ட தமிழீழ விடுதலைப் புலிகள் இயக்கம் மெதுவாக மரபு வழிப்படையாகத் தம்மை நிலைநிறுத்திக் கொள்ள முயன்றனர்.

இக்காலப் பகுதியில் தமிழீழ விடுதலைப் புலிகள் இயக்கம் படையணிகள் ரீதியாகவும் போர் முறைகளிலும் மாற்றங்களைச் சந்தித்ததுடன் ஒரு அரை மரபு வழிப்படையாக மாற்றம் கண்டு வந்தது.

அதாவது ஒரு மரபு வழிப்படைக்கு இருக்க வேண்டிய படைக்கட்டுமானங்கள் முழுமை பெறாத நிலையில் ஒரு நவீன மரபு வழிப்படைகளை எதிர்த்துக் களமாட வேண்டிய சூழலில் யாழ். மாவட்டச் சிறப்புத் தளபதியாக பிரிகேடியர் செயற்பட்டார்.

அதாவது போராட்டத்தின் பிரதான தளத்தினைப் பாதுகாக்கும் தளபதியாக செயற்பட்டார்.

அத்தோடு அவர் யாழ். மாவட்டத் தளபதியாக பணியாற்றிய அக்காலப் பகுதியில் வட போர்முனையின் கட்டளைப்பீடமாகத் திகழும் பலாலி முக்கூட்டுப் படைத்தளத்தின் அச்சுறுத்தலிலிருந்து போராட்டத்தின் மையத்தளமாக திகழ்ந்த யாழ்ப்பாணத்தை பாதுகாப்பதற்கான ஒரு தற்காப்புச் சமருக்கு முகங்கொடுத்த அதேவேளை இவரது தலைமையில் பல வலிந்த தாக்குதல்களும் முன்னெடுக்கப்பட்டன.

ஆகாயக்கடல் வெளிச்சமரைப் பொறுத்த வரையில் தமிழீழ விடுதலைப் புலிகள் இயக்கம் முன்னெடுத்த முதலாவது மிகப்பெரும் மரபுவழிச்சமராக அது அமைந்ததோடு அனைத்துலக ஊடகங்களினதும், படை ஆய்வாளர்களினதும் கவனத்தை ஈர்த்த ஒரு சமராகவும் அது திகழ்ந்தது. இந்தச் சமரில் கடல் வழியிலான படை இறக்கத்துக்கு எதிரான சமருக்கு பிரிகேடியரே பொறுப்பாகச் செயற்பட்டார்.

இந்தச் சமரில் விழுப்புண்ணடையும் வரை அவர் களத்தை வழிநடத்தினார். இக்காலப் பகுதியில் கடற்புலிகளின் உருவாக்கமோ அல்லது கிட்டுப் பீரங்கிப் படையணி மற்றும் குட்டிசிறி மோட்டார் படைப்பிரிவின் உருவாக்கமோ ஏதும் இல்லையென்பது குறிப்பிடத்தக்கது.

இந்த நிலையில்தான் 1993 ஆம் ஆண்டு காலப்பகுதியில் தமிழீழ விடுதலைப் புலிகள் இயக்கம் உள்ளார்ந்த ரீதியாக ஒரு மிகப்பெரும் நெருக்கடிக்கு முகம் கொடுத்த நிலையில் தமிழீழ அரசியல்துறைப் பொறுப்பாளராக பிரிகேடியர் நியமிக்கப்பட்டார்.

படைத்துறை ரீதியாக களங்களை வழிநடத்திய ஒருவர் ஒரு விடுதலை இயக்கத்தின் கடினம் மிக்க அரசியற் பணியை ஆற்றும் பொறுப்பையேற்றார்.

இவரது அரசியற்பணியானது இவர் அரசியல்துறைப் பொறுப்பாளராக பொறுப்பேற்ற 1993 ஆம் ஆண்டிலிருந்து 2007 ஆம் ஆண்டு வரையான காலப்பகுதி பல்வேறு வகையிலும் முதன்மை பெற்றதாகவுள்ளது.

ஏனெனில் உலகின் எந்தவொரு விடுதலை இயக்கமும் சந்தித்திராத மிகப்பெரும் நெருக்கடிகளுக்கு தமிழீழ விடுதலைப் புலிகள் இயக்கம் முகங்கொடுத்துக் கொண்டிருந்த நிலையில் அரசியற்பணியை முன்னெடுக்க வேண்டிய சூழமைவு அவருக்குக் காணப்பட்டது.

இந்த நிலையிலும் அவர் நெருக்கடிமிக்க பல செயற்றிட்டங்களைச் சீர்செய்யும் வகையிலான வேலைத்திட்டங்களுக்கு தலைமை தாங்க வேண்டியிருந்ததுடன் அதனை வெற்றிகரமாகவும் செயற்படுத்தினார். இப்பணியை நாம் இரண்டு வகையில் நோக்கலாம்.

ஒரு விடுதலை இயக்கத்தின் இலட்சியம், கொள்கை என்பவற்றை செவ்வனே மக்கள் மத்தியில் கொண்டு சென்று மக்கள் ஆதரவுத் தளத்தைக் கட்டியெழுப்பும் பணியை ஆற்றுவது மிகக் கடினமான ஒரு பணியாகும்.

தொடர்ச்சியான போர் நெருக்கடிகளுக்கு மத்தியில் வாழும் மக்களிடையே இப் பணியை ஆற்றுவதென்பது மிகப் பெரும் சிரமத்தைக் கொண்டது. ஆயினும் இப்பணியை பல்வேறு நெருக்குவாரங்களுக்குமிடையே அவர் முன்கொண்டு சென்றார்.

விடுதலை அமைப்பின் கொள்கையை முன்னெடுப்பது, மக்களை அணிதிரட்டுவது, விடுதலை இயக்கத்திற்கு எதிரான அனைத் துலகத்தின் இராஜதந்திர சமர்களுக்கு முகம் கொடுக்கின்ற அதேவேளை இலட்சியத்தின் மீது மக்களைத் தொடர்ந்து உறுதி கொள்ளச் செய்வது என்பவற்றோடு ஒரு நடைமுறை அரசிற்கான கட்டுமானங்களை உருவாக்கும் தலைமையின் எண்ணங்களுக்கு செயல் வடிவம் கொடுப்பது எனப் பரந்துபட்ட வேலைத்திட்டங்களை அவர் முன்னெடுக்க வேண்டியிருந்தது.
ஆயினும் இக்காலப்பகுதியில் இவர் ஒரு மிகப் பெரும் போர் இடப்பெயர்வு நெருக்கடிக்கும், இயற்கை அழிவுகளுக்கும் முகம் கொடுத்த மக்களின் புனர்வாழ்வு அபிவிருத்தி, மீள்குடியேற்றம் என்ற வாழ்வியல் நெருக்கடிகளையும் வெற்றிகரமாகக் கையாண்டார்.

யாழ்ப்பாண இடப்பெயர்வைப் பொறுத்த வரையில் சுமார் ஐந்து இலட்சத்திற்கும் மேற்பட்ட மக்கள் ஒரே இரவில் இடம்பெயர்ந்த சூழ்நிலையில் அதற்கு முகம் கொடுத்து வன்னியை நோக்கி இடம்பெயர்ந்த மக்களின் இருப்புக்கு வழிகோலியது அவரது அரசியற்பணிக் காலத்தில் ஈட்டிய மிகப்பெரும் சாதனையாக நோக்கத்தக்கது.

இத்தகையதொரு நிலையிலும் அரசியல்துறைக்கான சிவில் கட்டமைப்புக்கள் குலையாது அவற்றின் மீள் எழுச்சிக்கு பாடுபட்டமையானது முதன்மை மிக்க செயற்பாடாகும். இதேபோன்றுதான் 2004 ஆம் ஆண்டு தென்னாசியப் பிராந்தியத்தில் இந்தோனேசியாவின் சுமாத்திரா ஜாவா கடற்பரப்பில் ஏற்பட்ட நிலவதிர்வு காரணமாக கரையோரப் பிரதேசங்களில் ஏற்பட்ட ஆழிப்பேரலை அழிவிலிருந்து மக்களை துரிதகதியில் மீள்நிலைக்குக் கொண்டுவரும் செயற்றிட்டம் தேசிய ரீதியில் முன்னெடுக்கப்பட்டபோது அதனை வெற்றிகரமாக செயற்படுத்தி அனைத்துலக சமூகத்தின் பாராட்டு தலையும், கவனத்தையும் தாயகத்தை நோக்கி ஈர்த்தமையானது இவரது திறனிற்குச் சான்றாகும்.

அனைத்துலகத்தின் உதவிகள் முழுமையாக தமிழ் மக்களுக்கு வந்தடைவதை சிறிலங்கா அரசு தடுத்துக் கொண்டிருந்த நிலையில் எட்டக்கூடிய அனைத்து வளங்களையும் ஒன்றுதிரட்டி சிறிலங்காவை விஞ்சும் அளவுக்கு செயல்பூர்வமாக அதனை எதிர்கொண்டமையானது அனைத் துலக சமூகத்தின் கவனத்தை ஈர்த்தமைக்குக் காரணமாக இருந்தது.

இச்செயற்றிட்டமானது பாதிக்கப்பட்ட மக்களை துரிதகதியில் இயல்பு நிலைக்கு கொண்டுவர மிகவும் பயனுடையதாக அமைந்திருந்தது.

இது பிரிகேடியரின் அரசியற்பணியில் மக்களின் தளத்தில் அவர் ஆற்றிய மகத்தான பணியாக அமைந்தது என்றால் மிகையாகாது.
இதேவேளை தமிழீழ விடுதலைப் போராட்டத்தில் இவரது இராஜதந்திரப் பணி வித்தியாசமானதாகும்.

அரசுகளுக்கிடையான இறுக்கமான பிணைப்பினூடாக முன்னெடுக்கப்பட்டு வரும் இராஜீக உறவுகளுக்கு நடுவே விடுதலை அமைப்பொன்றின் புரட்சிகர அரசியலை அனைத்துலக நாடுகளின் ஒத்திசைவுப் போக்கின் நடுவே முன்கொண்டு செல்லுதல் என்பது ஒரு கடினமான பணியாகும்.

விட்டுக் கொடுப்புக்கள் என்ற பேரிலும் இணைந்து செயற்படுதல் என்ற கோதாவிலும் ஒரு விடுதலை அமைப்பை அரசியல் நீரோட்டத்துக்குள் கொண்டுவருதல் என்ற புனிதம் கெட்ட இராஜதந்திர வலைப் பொறிக்குள் வீழ்த்திவிட முயலும் அனைத்துலக இராஜதந்திர முயற்சிகளுக்கு ஈடு கொடுத்து இலட்சியத்தையும், தலைமையின் முடிவுகளையும் பாதுகாக்கின்ற இராஜதந்திரப் பாத்திரத்தை பிரிகேடியர் ஏற்றிருந்தார்.

இன்றைய அனைத்துலக சமூகமானது அனைத்துலக ரீதியாக குருட்டுத்தனப் பார்வையூடாக எல்லா இனங்களின் போராட்டங்கள் மற்றும் முன்னெடுப்புக்கள் மீது பயங்கரவாத முத்திரை குத்த முனைந்து வரும் இன்றைய உலக யதார்த்ததில் ஒரு புரட்சிகர இராஜதந்திரப் பணியை பிரிகேடியர் மேற்கொண்டிருந்தார்.

சமாதானம் அடிமைகளை உருவாக்கு கிறதென்றால் அதற்குச் சுதந்திரத்தை சாகடிக்கும் வல்லமை இருப்பதானாலேயேயாகும்.
அந்தச் சாகடிக்கும் வல்லமைக்குச் சவாலாக தமிழினத்தின் அரசியல் பணியை முன்னெடுத்து விடுதலைப் போராட்டத்திற்கு அரசியல் ரீதியான காப்பை பெறுவதென்பது மிகக் கடினமான பணியாகும்.

அதிலும் பல்வேறு நாடுகளிலும் தடைசெய்யப்பட்ட ஒரு விடுதலை அமைப்பின் அரசியல் பிரிவுத் தலைவராக நின்று சர்வதேச சமூகத்தின் எதிர் முகத்தை எதிர்கொள்வது இலகுவான காரியமல்ல.

பேச்சு என்ற சாக்கில் சர்வதேச சாசனங்களின் பொறிக்குள் வீழ்த்தி தமிழினத்தின் விடுதலைக் கனவை கலைத்துவிட முயலும் சூழ்ச்சிக்கு பலியாகாது சுதந்திர இயக்கத்தின் இலட்சியத்தை முன்கொண்டு செல்வதில் பிரிகேடியர் ஆற்றலோடு பணியாற்றினார்.

இதன்போது அனைத்துலக சமூகத்தின் அத்தனை இராஜதந்திரப் பிரயோக வடிவங்களுக்கும் அவர் முகங்கொடுக்க வேண்டியேற்பட்டபோதும் அவர் இலட்சியத்தை எந்தவொரு கட்டத்திலும் சிக்கலுக்கோ, சிரமத்துக்கோ உள்ளாக்க நேரிடும் வகையில் செயற்படவில்லை என்பது நோக்கத்தக்கது.

பிரிகேடியர் அவர்களின் பதின் மூன்றாண்டு கால அரசியற் செயற்பாடுகளின்போது இரண்டு சமாதான பேச்சுக்களை எதிர்கொண்டுள்ளார்.

இவ்விரு சமாதானப் பேச்சுவார்த்தைகளின் போதும் பலகட்ட சமாதானப் பேச்சுவார்த்தைகள் பிரிகேடியரின் தலைமையில் மேற்கொள்ளப்பட்டன.

அனைத்துலக சமூகத்தின் இராஜதந்திர சிக்கல்களுக்குள்ளோ, அனைத்துலக ஊடகங்களின் சிக்கலுக்குள்ளோ அகப்படாது அவர் நேர்த்தியாக முன்கொண்டு சென்றிருந்தார். இதில் நோர்வே அனுசரணையுடன் முன்னெடுக்கப்பட்ட அமைதியில் எட்டாவது கட்ட சமாதானப் பேச்சுவார்த்தையானது அதாவது ஜெனீவா பேச்சுவார்த்தை பிரிகேடியர் தலைமையேற்று முன்னெடுத்திருந்த மிகச் சிறந்த சமாதானப் பேச்சுவார்த்தைகளில் ஒன்றாகும்.

பிரிகேடியரின் இராஜதந்திரப் பணிக்காலத்தில் அவர் ஆற்றிய மிகச் சிறந்ததும் மிகவும் பாராட்டப்பட்டதுமான ஒரு இராஜதந்திரப் பணியாகவே ஜெனீவா நோக்கப்படுகிறது.

தமிழ் மக்களைப் பொறுத்தவரையில் தீர்வுகளோ இணக்கப்பாடுகளோ ஏதுமற்ற நிலையில் ஐந்தாண்டுகளாகப் பேச்சுக்கள் மட்டுமே நீடித்து வந்த நிலையில் தமிழ்மக்களுக்கு ஏற்பட்டிருந்த ஆகக் குறைந்தளவிலான மனிதாபிமான நெருக்கடிகளைக் கூட களையமுனையாத சிறிலங்கா அரசின் போக்கை ஜெனீவா சமாதானப் பேச்சுவார்த்தையில் அனைத்துலக சமூகத்தின் முன்னிலையில் வெளிப்படுத்தி ஜெனீவா சமாதானப் பேச்சுவார்த்தையின் முழுத்தோல்விக்கும் சிறிலங்கா அரசே பொறுப்பென்பதை அந்தச் சமாதானப் பேச்சின் போது அவர் நிரூபித்திருந்தார்.

அத்தோடு ஜெனீவா- சமாதானப் பேச்சுவார்த்தைக்கு தமிழர் தரப்பில் தலைமை தாங்கிய பிரிகேடியர் சிறிலங்கா அரசின் தரப்பில் பேச்சு நாகரிகத்தைக் கூட கடைப்பிடிக்காத அநாகரிகப் போக்கு காணப்பட்ட நிலையிலும் பிரிகேடியர் நிதானமாகவும் அறிவுபூர்வமாகவும் ஜெனீவா- பேச்சுவார்த்தையை கையாண்டிருந்தமையை இராஜதந்திர வட்டாரங்கள் அன்று பாராட்டிப் பேசியிருந்தமை கவனிக்கத்தக்கது.

ஆயினும் இந்தப் பேச்சுவார்த்தை தோல்வியடைந்த நிலையில் மீண்டுமொரு பேச்சுக்கான திகதியை நிர்ணயிக்கும் ஒரு வலுவிழந்த கோரிக்கையை பிரிகேடியரின் முன்னிலையில் அனுசரணையாளர்கள் முன்வைத்த போது அவர் உறுதியாக அக்கோரிக்கையை நிராகரித்து தமிழர் தரப்பின் உறுதியை நிலை நிறுத்தியிருந்தார்.

ஒரு கட்டத்தில் மென்போக்கு இராஜதந்திர அணுகுமுறையிலிருந்து சற்றே விலகி அச்சுறுத்தும் இராஜதந்திர அணுகுமுறையை அனைத்துலக சமூகம் கையாண்டபோது கூட பிரிகேடியர் புலிகளுக்கே உரித்தான உறுதியோடு அவற்றை நிராகரித்திருந்தார்.

அதாவது அடுத்த கட்டப் பேச்சுக்கான திகதி நிர்ணயம் செய்யப்படாது விட்டால் தமிழர் தரப்பு பேச்சுக்குழு கொழும்பினூடாக பயணம் செய்வதில் சிக்கல்கள் ஏற்படும் என்ற தொனியில் மிரட்டல் இராஜதந்திரத்தை பிரயோகித்த போது பிரிகேடியர் ஜெனீவாவில் வைத்து சர்வதேச இராஜதந்திரிகளுக்கு புலிக்குணத்தை வெளிப்படுத்தினார்.

அந்தச் சம்பவத்தைப் பிரிகேடியரே பின்னர் பின்வருமாறு தெரிவித்திருந்தார். அதாவது அடுத்த பேச்சுக்கான திகதியை நிர்ணயம் செய்யாது போகும் பட்சத்தில் கொழும்பு கட்டுநாயக்க விமான நிலையத்தினூடாக பிரயாணம் செய்வதில் சிக்கல்கள் ஏற்படலாம் என்பதற்கு… இதுவொன்றும் எங்களுக்குப் பிரச்சினையில்லை. இந்தியாவினுடைய சமாதான முயற்சியின்போது இந்தியாவின் தவறான செயற்பாடு காரணமாக நாங்கள் அப்போது பன்னிரெண்டு போராளிகளை இழந்தோம். இப்போதும் ஏதேனும் சிக்கலை ஏற்படுத்தினால் மேலும் பதின்மூன்று போராளிகளை எமது விடுதலை இயக்கம் இழக்க நேரிடும். ஆனால் இது நோர்வேயின் சமாதான முயற்சியில் ஒரு புதிய தொடக்கமாக இருக்கும் எனச் சாவிற்கு அஞ்சாத புலிகளின் குண இயல்புநிலையில் மிகக் காட்டமாக அனுசரணையாளர்களுக்கு பதிலளித்தார்.

HRW: US report ignites call for war crimes investigations against Sri Lanka

The US State Department war crimes report to the Senate submitted as mandated by the explanatory statement to the US Supplemental Appropriations Act of 2009, detailed day-by-day account in a format similar to a "model indictment," and said the alleged incidents in the final stages of war may constitute "violations of International Humanitarian Law (IHL) or crimes against humanity and related harms." Brad Adams, Asia director at Human Rights Watch (HRW), said, "[g]iven Sri Lanka's complete failure to investigate possible war crimes, the only hope for justice is an independent, international investigation," and added, "concerned governments should use the US State Department report as a clarion call for an international investigation. There are no more excuses for inaction."

The report while not reaching any legal conclusions listed Common Article 3 of Geneva Conventions, statutes of International Criminal Tribunal for the former Yugoslavia (ICTY), and Rwanda (ICTR), and the statutes of International Criminal Court (ICC) as "useful foundation for reviewing the conduct" described in the State Department's report.

Legal experts pointed out that under basic rules of international criminal law, the US has to give the GoSL the opportunity to investigate itself credibly, and that, further steps are warranted by the international community, if and when the GOSL fails or refuses to do so.

Meanwhile, Tamil circles pointed out that the international community, including the U.S., was responsible for the plight of the Eezham Tamils and the elimination of their de-facto state through a genocidal war, and therefore real 'reconciliation' comes only when the national question is internationally addressed and when appropriate gestures to this effect come from the IC.

The listing in the report of the same three treaties, the International Covenant on Civil and Political Rights (ICCPR), the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) and the Convention on the Rights of the Child (CRC), that form the basis for the European Union to determine the human rights thresholds for providing benefits to Governments under the GSP+, made even more remote, the possibility of Sri Lanka obtaining GSP+ concessions. Recent report by the EU commission said that Sri Lanka failed to meet the established rights thresholds.

The US report showed Satellite imagery evidence as possible tool to fill the information vacuum engineered by the Sri Lanka Government to prevent details of illegal conduct by the Sri Lanka armed forces from reaching outside Sri Lanka, and mentioned that independent investigations on the channel-4 video are still to be carried out to establish authenticity of Sri Lanka Army (SLA) soldiers executing captive Tamils.

Another noteworthy aspect of the report is the prominence given to the alleged execution of members of the LTTE political section while surrendering to the Sri Lanka military.

Thousands of noncombatants, according to the United Nations, were killed in the final phase of the Sri Lankan war this year as government forces overran the Tamil Tiger guerrillas. Nearly five months after Colombo's stunning military triumph, the peace dividend remains elusive, with President Mahinda Rajapaksa setting out--in the name of "eternal vigilance"--to expand by 50% an already-large military. Little effort has been made to reach out to the Tamil minority and begin a process of national reconciliation.

China, clearly, was the decisive factor in ending the war through its generous supply of offensive weapons and its munificent aid. It even got its ally Pakistan to actively assist Rajapaksa in his war strategy. Today, China is the key factor in providing Colombo the diplomatic cover against the institution of a U.N. investigation into possible war crimes, or the appointment of a U.N. special envoy on Sri Lanka. In return for such support, Beijing has been able to make strategic inroads into a critically located country in India's backyard.

Unlike China's assistance, India's role has received little international attention. But India, too, contributed to the Sri Lankan bloodbath through its military aid, except that it has ended up, strangely, with its leverage undermined.

For years, India had pursued a hands-off approach toward Sri Lanka in response to two developments--a disastrous 1987-1990 peacekeeping operation there; and the 1991 assassination of former Prime Minister Rajiv Gandhi by a member of the Tamil Tigers. But having been outmaneuvered by China's success in extending strategic reach to Sri Lanka in recent years, New Delhi got sucked into providing major assistance to Colombo, lest it lose further ground in Sri Lanka.

From opening an unlimited line of military credit for Sri Lanka to extending critical naval and intelligence assistance, India provided sustained war support despite a deteriorating humanitarian situation there. A "major turning point" in the war, as Sri Lankan navy chief Admiral Wasantha Karannagoda acknowledged, came when the rebels' supply ships were eliminated, one by one, with input from Indian naval intelligence, cutting off all supplies to the rebel-held areas. That in turn allowed the Sri Lankan ground forces to make rapid advances and unravel the de facto state the Tigers had established in the island nation's north and east.

Sri Lanka, for its part, practiced adroit but duplicitous diplomacy: It assured India it would approach other arms suppliers only if New Delhi couldn't provide a particular weapon system it needed. Yet it quietly began buying arms from China and Pakistan without even letting India know. In doing so, Colombo mocked Indian appeals that it rely for its legitimate defense needs on India, the main regional power. It was only by turning to India's adversaries for weapons, training and other aid that Colombo pulled off a startling military triumph. In any event, Colombo was emboldened by the fact that the more it chipped away at India's traditional role, the more New Delhi seemed willing to pander to its needs.

Today, India stands more marginalized than ever in Sri Lanka. Its natural constituency--the Tamils--feels not only betrayed, but also looks at India as a colluder in the bloodbath. India already had alienated the Sinhalese majority in the 1980s, when it first armed the Tamil Tigers and then sought to disarm them through an ill-starred peacekeeping foray that left almost three times as many Indian troops dead as the 1999 Kargil War with Pakistan.

India's waning leverage over Sri Lanka is manifest from the way it now has to jostle for influence there with arch-rivals China and Pakistan. Hambantota--the billion-dollar port Beijing is building in Sri Lanka's southeast--symbolizes the Chinese strategic challenge to India from the oceans.

Even as some 280,000 displaced Tamils--equivalent to the population of Belfast--continue to be held incommunicado in barbed-wire camps, India has been unable to persuade Colombo to set them free, with incidents being reported of security forces opening fire on those seeking to escape from the appalling conditions. One of the few persons allowed to visit some of these camps was U.N. Secretary-General Ban Ki-moon, who said after his tour in May: "I have traveled around the world and visited similar places, but these are by far the most appalling scenes I have seen ..." Prime Minister Manmohan Singh said recently that India has conveyed its "concerns in no uncertain terms to Sri Lanka on various occasions, stressing the need for them to focus on resettling and rehabilitating the displaced Tamil population at the earliest." But India seems unable to make a difference even with messages delivered in "no uncertain terms."

The story of the loss of India's preeminent role in Sri Lanka actually begins in 1987, when New Delhi made an abrupt U-turn in policy and demanded that the Tigers lay down their arms. Their refusal to bow to the diktat was viewed as treachery, and the Indian army was ordered to rout them.

Since then, Sri Lanka has served as a reminder of how India's foreign policy is driven not by resolute, long-term goals, but by a meandering approach influenced by the personal caprice of those in power. The 1987 policy reversal occurred after then Sri Lankan President J.R. Jayewardene--a wily old fox--sold neophyte Prime Minister Rajiv Gandhi the line that an "Eelam," or Tamil homeland, in Sri Lanka would be a dangerous precursor to a Greater Eelam uniting Tamils on both sides of the Palk Straits. In buying that myth, Gandhi did not consider a simple truth: If Bangladesh's 1971 creation did not provoke an Indian Bengali nationalist demand for a Greater Bangladesh, why would an Eelam lead to a Greater Eelam?

Actually, the Tamils in India and Sri Lanka have pursued divergent identities since the fall of the Pandyan kingdom in the 14th century. While the Eelam struggle is rooted in the treatment of Tamils as second-class citizens in Sri Lanka--where affirmative action has been instituted for the majority Sinhalese and a mono-ethnic national identity sought to be shaped--the Tamils in India face no discrimination and have been fully integrated into the national mainstream.

Another personality driven shift in India's Sri Lanka policy came after the 2004 change of government in New Delhi, when the desire to avenge Gandhi's assassination trumped strategic considerations, with the hands-off approach being abandoned. That handily meshed with the hawkish agenda of Rajapaksa, who began chasing the military option soon after coming to power in 2005. "It is their duty to help us in this stage," Rajapaksa said about India. And Indian help came liberally.

In fact, such has been the unstinting Indian support that even after the crushing of the Tamil Tigers, India went out of the way to castigate the U.N. high commissioner for human rights, Navi Pillay, in June for shining a spotlight on the deplorable human-rights situation in Sri Lanka, including the continuing internment of internally displaced Tamils. India accused Pillay--a distinguished South African judge of Indian descent who has sought an independent international investigation into alleged war crimes committed by all sides in Sri Lanka--of going beyond her brief, saying "the independence of the high commissioner cannot be presumed to exceed that of the U.N. secretary-general."

The costs of lending such support have been high. New Delhi today is groping to bring direction to its Sri Lanka policy by defining its objectives more coherently, even as it struggles to respond to the Chinese strategy to build maritime choke points in the Indian Ocean region. Indeed, India has ceded strategic space in its regional backyard in such a manner that Bhutan now remains its sole pocket of influence. In Sri Lanka, India has allowed itself to become a marginal player despite its geostrategic advantage and trade and investment clout.

More fundamentally, the pernicious myth Jayewardene planted in Gandhi's mind triggered a chain of events still exacting costs on Indian security and interests. In fact, nothing better illustrates the fallacy Jayewardene sold Gandhi than the absence of a Tamil backlash in India to the killings of thousands of countless Tamil civilians in Sri Lanka this year, and to the continued incarceration in tent camps of 280,000 Tamil refugees, including 80,000 children. In fact, even as the Sri Lankan war reached a gory culmination, India's Tamil Nadu state voted in national elections for the United Progressive Alliance (UPA) led by Gandhi's widow, Sonia Gandhi, although that governing coalition had shied away from raising its voice over the Sri Lankan slaughter.

Today, the upsurge of Sinhalese chauvinism flows from the fact that the Sri Lankan military accomplished a task whose pursuit forced the mightier Indian army to make an ignominious exit 19 years ago. Consequently, Colombo is going to be even less inclined than before to listen to New Delhi. Indeed, the manner in which Colombo played the China and Pakistan cards in recent years to outsmart India is likely to remain an enduring feature of Sri Lankan diplomacy, making Sri Lanka a potential springboard for anti-India maneuvers.

Neither Sri Lanka nor Israel should have impunity in their 'wars on terror'

Israel’s war against the Gazan people in December and January devastated the tiny Strip, killing over 1,400 people, a majority of whom were civilians. The Western powers, including America, England and Australia, backed Israel’s battle against Hamas and shared its belief that destruction of the Islamist group would benefit their interests.

More than six months later, however, the political realities in the region remain virtually unchanged, with Hamas still in control of Gaza, Israel and Egypt imposing an inhumane siege on the area and Israel regularly launching military strikes against “terrorist” targets.

During my visit there in July, I found many of the 1.5 million Palestinians desperate for a normal life, something denied to them for decades due to Israeli occupation and irregular bombardment.

The recent UN released report on Gaza, investigated by distinguished South African Justice Richard Goldstone, found overwhelming evidence that both Israel and Hamas committed war crimes during the conflict and should be held to account in an international tribunal. Goldstone stressed that the culture of impunity endemic in the Middle East must end the targeting of civilians and their infrastructure and the lack of international will to fully investigate the atrocities carried out in the name of “defeating terrorism.”

Goldstone told US magazine Tikkun that, “the powerful are protected because of their power. But it’s not prejudice it’s politics. They use their power to protect themselves.” Israel and US are determined that the former never face justice for its crimes.

Compare the international outcry over the Gaza massacre to the relative silence toward Sri Lanka’s war against the Tamil people in 2008 and 2009. Conservative estimates place the death roll at over 20,000 people, perhaps as high as 50,000. The Colombo regime dismissed all attempts to cease its military operations, negotiate with the Tamil Tigers or allow the transfer of hundreds of thousands of civilians to safety. Today, close to 300,000 Tamils are trapped in government-imposed camps, surrounded by barbed wire and unable to leave.

The International Crisis Group told the European Parliament in early October that “such restrictions on freedom in the absence of due process are a violation of both national and international law.”

Sri Lanka was fighting its own “war on terror” with the Israeli playbook. Ban all independent media from the war zone, demonize human rights groups as sympathetic to terrorists, dismiss all questioning of tactics as giving in to terrorism and support the doctrine of overwhelming fire-power. Like Israel, Sri Lanka won the battle, but will inevitably lose the war.

Israel has battled Palestinian nationalists for decades and remains unable to destroy the spirit of the people. Independence for the Palestinian people will come one day. Despite extensive media coverage and global sympathy for their cause, the Palestinians are today still stateless and under occupation. But their plight is far better understood than the Tamils.

Israel’s ambassador to Britain, Ron Prosor, wrote in the London Times in late September that the “farcical” United States Human Rights Council, tasked to investigate the Gaza massacre, should not examine Israel because, it “did its utmost to direct Palestinian civilians out of harm’s way.” Every human rights group in the world has evidence to prove the fallacy of this argument. Israel should be treated like any other country calling itself a democracy and not excused because of its bellicose tactics in the global arena.

A growing number of Jewish groups are joining this call, unafraid of being labelled anti-Semitic or self-hating and simply believing in equitable justice. An initiative I co-founded, Independent Australian Jewish Voices, is part of this conversation, regularly working with Palestinians over our shared concerns.

Proser demanded to know why the UN wasn’t investigating the “300,000 Tamil civilians currently languishing in Sri Lanka.” It’s a fair question, except his ideal outcome would be impunity for Western states fighting their own “war on terror.” In this worldview, it’s only developing or Third World nations worthy of sanction.

Sadly, the vast majority of Muslim and Middle East countries, except Bosnia, voted with Sri Lanka in the UN Human Rights Council in May to support its war against the Tamil people. The idea of non-democratic nations backing a brutal regime isn’t new; defeating “terrorism” is a language democracies and dictatorships both share. The fact that the UN is a flawed body doesn’t prevent it from conducting important work in the field of human rights and abuse prevention.

Sri Lanka doesn’t enjoy favored nation status like Israel but it should face a thorough examination of its conduct during the war. Many states, such as Israel and China, have no desire to discover the truth behind the conflict because they provided arms to the Sri Lankan government. Israel is reportedly protecting Sri Lanka from any American pressure against its actions. But obstacles to international justice should not preclude their commencement. Crimes in Congo, Sierra Leone, Cambodia and the former Yugoslavia were thoroughly investigated by legal bodies, even if the final outcomes were not perfect.

It is time for the Sri Lanka leaders to understand that destroying a terrorist infrastructure without political and social assistance to the vanquished is doomed to failure. The Sri Lankan government will need to be convinced that normal relations with the world will not be possible until its crimes against the Tamils are acknowledged.
Peace with justice demands nothing less.

Poor Conditions of Concentration Camps - Tamil Eelam /Srilanka

New film appears to reveal the victims of Sri Lanka's war suffering poor conditions in UN-funded camps. They are among the victims of Sri Lanka's civil war, living in camps funded by the UN.

Now footage has come to light apparently showing how bad conditions are in the camps - patients on intravenous drips lying on mud floors, a man so weak he is unable to brush the flies from his face. The mobile phone footage, from the group War Without Witness, was reportedly shot two weeks ago in Vavuniya, in northern Sri Lanka, where 200,000 displaced Tamils are being held.

The concern now is that when the monsoon rain season begins, the camp will be flooded. The plight of Tamil children was raised by Unicef spokesman James Elder, who has just been expelled from the country

It is now three months since Sri Lankan President Mahinda Rajapaksa declared the country "liberated" from the Liberation Tigers of Tamil Eelam (LTTE) rebels after a 26-year war.

He said then that he wanted to settle most of the displaced Tamil civilians within 180 days--but today, with more than half that time elapsed, nearly 300,000 are still being held in "internment camps," to which the media and humanitarian organizations have virtually no access.

One person who was able to visit some of them in May was UN Secretary General Ban Ki Moon. He said: "I have traveled round the world and visited similar places, but these are by far the most appalling scenes I have seen...."
In mid-August, these camps were flooded by downpours which, according to The New York Times, "sent rivers of muck cascading between tightly packed rows of flimsy shelters, overflowed latrines and sent hundreds of families scurrying for higher ground."

"We all knew that the monsoon rain would come," says Nimalka Fernando, a Sri Lankan human rights activist and lawyer. "Many alerted the authorities. The government should have evacuated the displaced people earlier. It is terrible now. I am not sure whether the authorities can handle these conditions. Who can bear their children getting sick?"

Moreover, there is no public list of those being held in the camps, and many families do not know whether their loved ones are alive or dead.

The brutal and violent methods used by the LTTE during the conflict are beyond dispute. But while it was going on the government claimed to draw a distinction between LTTE fighters and the law-abiding Tamil population, whose genuine political grievances it would address once the "terrorists" had been defeated.
So far, nothing like that has happened. Although it has screened out those it believes were LTTE cadres and sent them to separate camps, the government repeatedly extends its own deadline for releasing the civilians who are still in the main camps.

People who question this inside Sri Lanka, like Fernando, are accused of being traitors in the pay of "the LTTE diaspora," while outsiders are accused of using humanitarian concerns as an excuse for neo-imperialist intervention. Sri Lankan journalists who criticized the government have been arrested, beaten and in some cases murdered in broad daylight, while many more have fled the country. Foreign journalists have been kicked out, and Human Rights Watch and Amnesty International are not allowed in.

In the last weeks of fighting an estimated 20,000 civilians lost their lives. Government forces are accused of shelling Tamil civilians and killing people who tried to surrender.

The LTTE are charged with using civilians as human-shields, forcibly recruiting them as fighters and shooting those who tried to flee. There are rumors of mass graves but no independent observer has been allowed into the war zones to investigate. The government claims to have won the "war on terror." within its own frontiers, and denies the right of countries that have been less successful to question its methods.

As one of the five "Colombo Powers" which organized the historic Bandung Conference in 1955, and a leading member of the Nonaligned Movement, Sri Lanka was, for many decades, a responsible democracy, even a model member of the international community. Surely, the people of Sri Lanka do not want to compromise that enviable status, and with it their good standing in the main groups that represent the developing world.

Friends of Sri Lanka the world over, especially in the developing world, do not understand why Rajapaksa chose Myanmar as the first country to visit after winning the war. They were concerned to read, on the government's own website, that one reason for this choice was that "the (Myanmar) generals are increasingly finding it difficult to contain insurgent groups in the country's northern frontier and are willing to learn some fresh lessons from President Mahindra Rajapaksa on how to defeat the enemy."

That is not what the international community in general, and the developing world in particular, wishes to learn from Sri Lanka. Rather, friends of Sri Lanka were -- and still are--expecting the country to be faithful to its democratic tradition and act on Rajapaksa's promises that the rights of minorities would be respected, that the displaced would be helped to return home, and that prisoners would be treated humanely.

We do not believe that most people in Sri Lanka agree with what some are saying in Colombo to the effect that developing country governments can best deal with internal opposition by crushing it ruthlessly and treating any advice to respect universal principles of human rights and humanitarian law (which Sri Lanka agreed to uphold when it signed and ratified many treaties and conventions) as hypocritical.

Sadly, the government's willingness to ignore these principles has met with very little international resistance. Even the United States, which has urged the rapid release of all civilians and deplored the government's slow timetable on political reform, is simultaneously encouraging US investors to "make Sri Lanka your next business stop."

This puts a heavy responsibility on all who are close to Sri Lanka's ruling elite and on Asia's key powers -- India, Japan and China -- which have been staunch supporters of the Rajapaksa government and have channeled large sums of money in its direction (much of it, recently, for humanitarian purposes). It is time for the people of these countries to insist on a full account of how their money is being spent, and for their governments to say clearly that further economic and political support will depend on the following conditions being fulfilled:

1. The United Nations, international Red Cross and voluntary agencies must be given full and unhindered access to care for and protect the civilians in the camps, and then help them return to wherever in their own country they choose to live.

2. A list of all those still alive and in custody should be published, so that families can stop searching for loved ones who are dead.

3. Any who continue to be detained as alleged LTTE combatants must be treated in accordance with the provisions of international law, and urgently given access to legal representation.

4. Accountability processes must be established to ensure that international aid is not diverted to purposes other than those for which it was given.

5. The Sri Lankan government should invite regional and international specialists in conflict reconciliation to help rebuild lives and communities.

6. Sri Lanka should request or accept a full UN investigation into war crimes committed by all parties during the war.

The government has won the war, and the world shares the feeling of relief visible among Sri Lanka's people. It remains for them to win the peace, and the rest of the world must help. That is the purpose of the demands listed above. World leaders as well as public opinion must insist on them, not only for the benefit of Tamils in general and the detainees in particular, but also for the hopes of democracy and human rights throughout Sri Lanka, and beyond. Peace won by the brutal humiliation of a people is rarely secure.

లిబరేషన్ టైగర్స్ ఆఫ్ తమిళ్ ఈలం (ఎల్ టి టి ఇ) అనేది తీవ్రవాద సంస్థనా, దాని మూడు దశాబ్దాల రక్తసిక్త చరిత్రలో చేసిన ఘోరమైన రాజకీయ, సాంస్కృతిక, సైనిక తప్పిదాలకు అది ఇప్పుడు మూల్యం చెల్లిస్తోందా, అసలు శ్రీలంకలో నివసిస్తున్న ఇరవైలక్షల పైచిలుకు తమిళులందరికీ ఎల్ టి టి ఇ ప్రాతినిధ్యం వహిస్తుందాలేదా, శ్రీలంక తమిళ సమస్యల పరిష్కారానికి ఎల్ టి టి ఇ హింసాత్మక, సాయుధపోరాట మార్గం ఎంచుకోవడం సరయినదేనా, వగైరా ఎన్ని ప్రశ్నలయినా ఇప్పుడు వేసుకోవచ్చు గాని నిజానికి ఆ ప్రశ్నలకు ఇప్పుడంత ప్రాధాన్యత లేదు. ఆ చర్చ ఇప్పుడు కేవలం పండిత చర్చే అవుతుంది. బహుశా శ్రీలంక అధ్యక్షుడుగా మహింద రాజపక్షే అధికారంలోకి వచ్చిన 2005 నవంబర్ నుంచీ, లేదా తమిళ ఈలం వాదులమీద పెద్ద ఎత్తున దాడి చేయాలని నిర్ణయించుకున్న 2006 అక్టోబర్ నుంచీ, ఒకవైపు విపరీతంగా సైనిక వ్యయాన్ని పెంచి, మరొకవైపు ఎల్ టి టి ఇ పై మానసిక యుద్ధాన్ని కొనసాగించి ముప్పేట దాడి సాగించిన కాలంలోనే ఆ ప్రశ్నలకు కాలం చెల్లిపోయింది.

ఇప్పుడిక సమస్య ఎల్ టి టి ఇ ది కాదు. ప్రపంచంలో ఏదో ఒక జన సమూహం ఆకాంక్షలను నెరవేర్చడం కొరకు సాయుధంగానో, నిరాయుధంగానో సుదీర్ఘకాలం పోరాడి, గెలిచి, ఓడి, అంతిమంగా ఓడి చరిత్ర గర్భంలో కలిసిపోయిన అనేక సంఘటిత నిర్మాణాల జాబితాలో ఎల్ టి టి ఇ చేరిపోయే క్రమం ఎప్పుడో మొదలయింది.

ఇప్పుడిక ప్రశ్న శ్రీలంకలో కనీసం రెండువేల సంవత్సరాలుగా జీవనం సాగిస్తూ, తమ స్వతంత్ర సాంస్కృతిక, భాషా అస్తిత్వాన్ని నిలబెట్టుకుంటున్న తమిళ జాతి జీవనం ఏమవుతుంది అనేది. ఆ దీర్ఘకాలిక సమస్య అలా ఉంచినా, ఇవాళ్టికివాళ శ్రీలంక సైనిక బలగాలు సాగిస్తున్న అతి క్రూరమైన నిర్బంధకాండలో పిట్టల్లా రాలిపోతున్న తమిళ ప్రజానీకపు జీవనపోరాటం గురించి ఆలోచించవలసి ఉంది. సైనికుల చక్రబంధం మధ్య అడవులలోనో, సైనికులు ఆక్రమించుకున్న తమ ఆవాసాలలోనో అణచివేతలో దుర్భరంగా బతుకు ఈడుస్తున్న లక్షలాది మంది తమిళులది. అంతర్జాతీయ సేవా సంస్థలు, వైద్య సహాయ సంస్థలు ఎంత ప్రయత్నిస్తున్నా, సైనిక అవరోధాల వల్ల ఉపశమనం దక్కకుండాపోతున్న చిన్నారి పిల్లలది, వృద్ధులది, అనారోగ్య పీడితులది. నామమాత్రపు శరణార్థి, సహాయ, పునరావాస శిబిరాలలో పోగువేసిన తమిళుల మందల మీద ఎటువంటి నిరాదరణ అమలవుతున్నదో స్వతంత్ర పరిశీలకులు కూడ చెపుతున్నదాన్ని బట్టి, శ్రీలంక సైన్యం ఎల్ టి టి ఇ ని అణచివేయడానికి మాత్రమే కాదు, పనిలోపనిగా శ్రీలంక తమిళులకు “పాఠం నేర్పే పవిత్ర కర్తవ్యాన్ని” చేపట్టినట్టు కనబడుతున్నది.

ఎల్ టి టి ఇ సాగించిన తమిళ ఈలం పోరాటాన్ని, అది చేపట్టిన అనేక పోరాటరూపాలను సమర్థించినా, సమర్థించకపోయినా, మనపొరుగునే, మనకళ్లముందే ప్రస్తుతం జరుగుతున్న ఈ మహామానవ విషాదం గురించి తప్పకుండా ఆలోచించవలసి ఉంది.

శ్రీలంకలో అత్యధిక సంఖ్యాక జాతిగా సింహళ జాతి తమ నేలమీది అల్ప సంఖ్యాక జాతులన్నిటినీ నిర్మూలించదలచుకున్నదనీ, జాతి దురహంకారంతో హిట్లర్ సాగించిన జాతిహనన కాండ తర్వాత అంతటి దుర్మార్గమైన మారణకాండకు పాల్పడడం ప్రారంభించిందనీ ఇరవయో శతాబ్ది శ్రీలంక చరిత్ర అంతా సాక్ష్యం పలుకుతుంది. నిన్నమొన్నటి విజయాల గర్వంతో శ్రీలంక సింహళ జాతి ఆ పనిని కొనసాగిస్తుందా? అందులోనూ విజయం సాధిస్తుందా? ఆ దారుణం జరిగిపోతుంటే సభ్య ప్రపంచమంతా మౌనసాక్షి లాగ ఉండిపోతుందా? ప్రపంచదేశాలన్నీ ఏం చేసినా, భాషనూ, ఉమ్మడి గతాన్నీ, సంస్కృతినీ పంచుకునే భారత తమిళులమీద ఈ హననకాండ ప్రభావం ఎలా ఉండబోతోంది? ఇవీ ఇవాళ ఆలోచించవలసిన ప్రశ్నలు.

నిజానికి శ్రీలంకలో తమిళజాతి జీవన్మరణ సమస్యలను ఎదుర్కోవడం ఇప్పుడే ప్రారంభం కాలేదు. “తమిళుల సమస్యలకు ఎల్ టి టి ఇ నే కారణం” అని ఇవాళ చచ్చిన పాము మీద మరొక రాయి విసరడానికి ప్రణబ్ ముఖర్జీ ఉత్సాహపడవచ్చుగాని, సింహళ పాలకవర్గాల చేతిలో శ్రీలంక తమిళులు అనుభవించిన దోపిడీ, పీడన, వివక్షల గురించి లక్షలాది అనుభవాలు, వేలాది పేజీల్లో నమోదయ్యే ఉన్నాయి. బ్రిటిష్ వలసవాదులు వెళ్లిపోయి, శ్రీలంక సింహళ జాతికి దేశాధికారం దక్కిన 1948 కన్న చాల ముందు నుంచీ కూడ, పరాయిపాలనలో కూడ సింహళ జాతీయులు సోదర తమిళులను అవమానాలపాలు చేశారనీ, పీడించారనీ, చిన్నచూపు చూశారనీ ఎన్నో ఆధారాలున్నాయి.

భారత కమ్యూనిస్టు ఉద్యమ నాయకుడు ఎ కె గోపాలన్ ఆత్మకథలో 1936 లో శ్రీలంక (అప్పటి సిలోన్) పర్యటించినప్పుడు అక్కడ భారత మలయాళీలమీద, తమిళులమీద సింహళీయులలో కనబడిన విద్వేషం గురించి వివరంగా రాశారు. ఆయన ప్రసంగించవలసిన ఒక సమావేశంపై సింహళీయులు రాళ్లు విసిరి దాన్ని భగ్నం చేయడానికి ప్రయత్నించినప్పుడు, తాను స్థానిక పత్రికలకు వ్యాసాలు రాశానని ఆయన వివరించారు. “భారతీయులకు, సింహళీయులకు మధ్య జరిగే వ్యక్తిగత తగాదాలకు కూడ జాతి వ్యతిరేకత రంగు పులమబడుతున్నదని, ఈ ధోరణిని అరికట్టకపోతే అతి దారుణమైన ఫలితాలు, పర్యవసానాలు ఉంటాయని” తాను ఆ వ్యాసాలలో హెచ్చరించానని గోపాలన్ రాశారు. నిజంగా ఏడు దశాబ్దాల తర్వాత ఆయన మాటలు ఎంత అక్షరసత్యాలో అర్థమవుతున్నాయి.

శ్రీలంక తమది మాత్రమేనని, అక్కడ ఉన్న ఇతర భాషల ప్రజలందరూ బయటివారేనని, ముఖ్యంగా తమిళ భాషా ప్రజలందరూ భారతీయులేనని, అందువల్ల వారు రెండవస్థాయి పౌరులుగా బతకవలసిందేనని సింహళుల విశ్వాసం. దేశంలోని అన్ని సింహళ రాజకీయపక్షాలకు వాటిలో వాటికి ఎన్ని విభేదాలున్నా, పరాయి జాతుల పట్ల వ్యతిరేకతలో మాత్రం ఏకాభిప్రాయమే.

అందుకే దేశ స్వాతంత్ర్యం రాగానే 1948లో డి ఎస్ సేనానాయకే నాయకత్వంలోని ప్రభుత్వం ప్రవేశపెట్టిన సిలోన్ పౌరసత్వపు చట్టం భారతీయ సంతతి వారికి పౌరసత్వాన్ని నిరాకరించే పేరుతో తమిళులందరి పౌరసత్వాన్ని రద్దు చేసింది. ఆ దుర్మార్గ చట్టాన్ని ఎత్తివేయించడానికి సుప్రీంకోర్టుకూ, చివరికి బ్రిటన్ లోని ప్రైవీ కౌన్సిల్ కూ మొరపెట్టుకుని ఓడిపోవడంతో, అంటే 1948 నుంచే ఆ దేశంలో తమిళుల ఆత్మగౌరవపోరాటం ప్రారంభమయింది.

ఆ తర్వాత 1956 లో దేశంలో సింహళాన్ని ఏకైక అధికార భాషగా ప్రకటిస్తూ మరొక చట్టం తేవడంతో సింహళ పాలకవర్గాల ఉద్దేశ్యాలు మరింతగా స్పష్టమయ్యాయి. ఆ చట్టాన్ని వ్యతిరేకిస్తూ తమిళ ప్రజాప్రతినిధులు చేసిన శాంతియుత సత్యాగ్రహాన్ని సింహళ సంస్థలు హింసాత్మకంగా అడ్డుకుని, తమిళులను ఊచకోత కోశాయి. ఆ తర్వాత, రాజ్యాంగంలో 1947 లోనే తమిళులకు కల్పించిన రక్షణలను తొలగిస్తూ సిలోన్ ప్రభుత్వం 1972లో రాజ్యాంగ సవరణను తీసుకొచ్చింది. అంతటితో సరిపోనట్టు, దేశంలో తమిళ జనాభా ఎక్కువగా ఉన్న ఉత్తర, తూర్పు ప్రాంతాల్లో, జననిష్పత్తిని మార్చడానికి అక్కడికి సింహళీయులను వలస పంపించి వారికి ఆవాసాలు కల్పించే పథకాన్ని శ్రీలంక ప్రభుత్వం 1980ల్లో మొదలుపెట్టింది.

ఈ విధానాలవల్ల మొత్తం మీద శ్రీలంకలో ఇప్పటికి నాలుగుసార్లు (1958, 1977, 1981, 1983) అతిపెద్ద జాతి కల్లోలాలు జరిగి వేలాది మంది బలి అయిపోయారు. ఆ తర్వాత ఇక తమిళుల సమస్య పరిష్కారం సమైక్య శ్రీలంకలో సాధ్యం కాదనీ, తూర్పు, ఉత్తర ప్రాంతాలతో స్వతంత్ర ఈలం (చరిత్రలో తమిళ స్వతంత్ర రాజ్యంగా కొనసాగిన సామ్రాజ్యం) స్థాపించుకోవలసిందేననీ, అటువంటి ఈలం శాంతియుత పోరాటపద్ధతులతో ఏర్పడడం సాధ్యం కాదనీ తమిళ ప్రజానీకం భావించడం ప్రారంభించింది. ఆ భావనకు వ్యక్తీకరణగానే అనేక సాయుధ పోరాట సంస్థలు పుట్టుకొచ్చాయి. అలాంటి దాదాపు డజను సంస్థలలో ఒక్కొక్కదాన్నీ పద్ధతి ప్రకారం నిర్మూలిస్తూ ఎల్ టి టి ఇ బలమయిన సంస్థగా అభివృద్ధి చెందింది. అప్పటినుంచీ సాగుతున్న అంతర్యుద్ధంలో కనీసం ఎనభై వేల మంది హతమయి ఉంటారని అంచనా.

పోరాట సంస్థల అనుభవాలలో ఎల్ టి టి ఇ ది ఒక విశిష్ట అనుభవం. అది ప్రపంచవ్యాప్తంగా తమిళ ప్రజల, పోరాటకారుల మద్దతు కూడగట్టుకుంటూ ఆర్థిక శక్తినీ, సైనిక శక్తినీ సమకూర్చుకుంది. ఒక దశలో భారత సైనిక బలగాల నుంచి శిక్షణనూ, ఆయుధాలనూ పొందింది. తనకు అనువైన నైసర్గిక వాతావరణంలో శ్రీలంక సైనిక బలగాలను మాత్రమే కాదు, అంతకన్న చాల బలమైన భారత సైనిక బలగాలను కూడ మట్టి కరిపించింది. సమాంతర ప్రభుత్వాన్ని నడిపింది. బహుశా ప్రపంచ చరిత్రలోనే మొదటిసారిగా సొంత విమానాలను, ఓడలను, జలాంతర్గాములను సంపాదించుకున్న పోరాటసంస్థగా ఘనతను సంపాదించింది. అంతర్జాతీయ స్థాయిలో పరపతిని కూడ పెంచుకుని తన తరఫున అంతర్జాతీయ సంస్థలో, నెదర్లాండ్స్ ప్రభుత్వం వంటి ప్రభుత్వాలో వకాల్తా పుచ్చుకునే పరిస్థితి కల్పించింది.

కాని ఈ క్రమంలోనే ఎల్ టి టి ఇ లోపలా బయటా శత్రువులను కూడ పెంచుకుంది. చాల సందర్భాలలో ఒంటరి అయిపోయింది. ఒక న్యాయమైన ప్రజా ఆకాంక్షకూ, దానికి నాయకత్వం వహించే సంస్థకు తెలిసో తెలియకో వచ్చే అహంకారానికీ మధ్య వైరుధ్యం ఒక అసాధారణ ప్రయోగం చేసిన పోరాటసంస్థను లోలోపలి నుంచి తినివేసింది.

అయితే అటువంటి సంస్థలు ఉంటాయా పోతాయా అనేదానికన్న ముఖ్యమైనది అవి వ్యక్తీకరించే ప్రజా సమస్యలకు ఏమవుతుందనేది. శ్రీలంకలో ఇవాళ సాగుతున్న పరిస్థితిని గత ఆరు దశాబ్దాల చరిత్ర నేపథ్యంలో చూస్తే, తమిళ ప్రజల జీవనం సింహళ పాలకవర్గాల చేతిలో మరింత దుర్భరంగా మారనున్నదనిపిస్తుంది. తమిళ ప్రజలు ఇంతకాలం అనుభవించిన వివక్ష కన్న మరింత ఎక్కువ వివక్షను, హింసను అనుభవించవలసి వస్తుందేమోననిపిస్తుంది. ఆ అణచివేత ఒక జాతి యావత్తునూ మరింతగా న్యూనతలోకి, పతనంలోకి, విధ్వంసంలోకి నెట్టవచ్చు. లేదా మరింత తీవ్రమైన, హింసాత్మకమైన ప్రతిఘటనకూ ప్రేరేపించవచ్చు. ప్రపంచచరిత్రలో రెండవ రకమైన ప్రతిస్పందన వచ్చిన దృష్టాంతాలే ఎక్కువ. ఈ రెండు పరిణామాలలో ఏది జరిగినా అది తమిళనాడులోని తమిళ ప్రజానీకపు మనసులమీద గాఢమైన ప్రభావం వేస్తుంది.

அமெரிக்காவில் மிகப் பிரபல்யமான தொலைக்காட்சிகளில் ஒன்றான CNN இல் இலங்கை இராணுவம் தமிழ் இளைஞர்களைச் சுட்டுக்கொல்லும் கோரக் காட்சிகள் ஒளிபரப்பாகியுள்ளன.

அந்த நிகழ்ச்சியில் அமைச்சர் கெகலிய ரம்புக்வெல்லவை தொடர்புகொண்டு CNN கேட்ட கேள்விகளால், இலங்கை அரசின் நம்பகத்தன்மை வெகுவாகப் பாதிக்கப்பட்டுள்ளது. அத்துடன் அந்த நிகழ்ச்சியில் கலந்துகொண்ட மனித உரிமை ஆர்வலர், இலங்கை அரசாங்கம் பொய்கூறிவருவதாக நேரடியாகவே தாக்கியுள்ளார். அதன் காணொளி இணைக்கப்பட்டுள்ளது.

வன்னி படையெடுப்பை நடத்திய சிறிலங்காப் படைகள் கைகளையும் கண்களையும் கட்டி வைத்துவிட்டுத் தமிழர்களைச் சுட்டுக்கொல்லும் பட்டவர்த்தனமான காட்சிகளை பிரித்தானிய காணொலிச் செய்திச் சேவையான 'சனல் -4' நிறுவனத்தின் ஜொனதன் மில்லர் வெளியிட்டுள்ளார்.

இந்தக் காணொலிக் காட்சிகளை வெளியிட்டுள்ள 'சிறிலங்காவில் ஜனநாயகத்திற்கான ஊடகவியலாளர்கள்' (Journalists for Democracy in Sri Lanka) என்ற அமைப்பு, இந்தக் காட்சிகள் கடந்த ஜனவரி 2009 இல் பதிவு செய்யப்பட்டதாகத் தெரிவித்துள்ளதாகவும், இதே காலப் பகுதியில் வெளிநாட்டு ஊடகவியலாளர்கள் போர்ப் பகுதிகளுக்குச் செல்வதை சிறிலங்கா அரசு தடை செய்துவிட்டிருந்தது எனவும் 'சனல் - 4' தெரிவிக்கின்றது.

இந்தக் காட்சிகள், "சிறிலங்கா அரசின் போர்க் குற்றங்களுக்கான ஆதாரங்களாக இல்லையா?" என ஜொனதன் மில்லர் கேள்வி எழுப்புகினன்றார்.

சிறீலங்காப் படையினரின் அதிர்ச்சி தரும் தமிழினப் படுகொலைகளின் புதிய காணொளி! (ஊடகங்களின் பயன்பாட்டுக்கான காணொளியும் இணைப்பு)

தமிழீழ விடுதலைப் புலிகளிடம் இருந்து நாட்டை மீட்டு விட்டோம் என்று சிறீலங்கா அரசாங்கம் அறிவித்து மூன்று மாதங்கள் கடந்துவிட்ட நிலையில், வெளிவந்துள்ள காணொளியானது சிறீலங்காப் படையினரிடம் அகப்பட்டுள்ள தமிழர்களை சிறீலங்கா அரசாங்கம் படுகொலை செய்கின்றது என்பதை உறுதி செய்துள்ளது.

தமிழ் இளைஞர்கள் மிகக் கொடூரமான முறையில் சித்திரவதைக்குள் உள்ளாக்கப்பட்டு, ஆடைகள் களையப்பட்டு, கண்கள், கைகள் கட்டப்பட்ட நிலையில் தரைவெளி ஒன்றுக்கு அழைத்து வரப்பட்டுள்ளனர். பின்னர் சிறீலங்காப் படையினர் குறிந்த இளைஞர்களைக் கேலி செய்து சிரிப்பதோடு, மூடுகாலணிகளால் உதைந்து அவர்களைக் சுட்டுச் கொன்றுள்ளனர்.

காணொளியில் ஒன்பது இளைஞர்களை சிறீலங்காப் படையினர் சுட்டுக் கொல்லப்பட்டுள்ளனர். இப்படுகொலைக் காணொளியானது சிறீலங்கா இராணுவச் சிப்பாய் ஒருவரிடம் இருந்து பெறப்பட்டுள்ளது. இக்காணொளியானது கடந்த சனவரிமாதம் பதிவு செய்யப்பட்டுள்ளது எனத் தெரிவிக்கப்பட்டுள்ளது.

குறிப்பு: மனதை மோசமாக பாதிக்கும் காட்சிகள் இந்த காணொலியில் இடம்பெற்றுள்ளன.

Channel 4 News shows footage claimed to show Sri Lankan forces executing Tamils earlier this year. Jonathan Miller reports.

Just three months after the Sri Lankan government declared the country liberated from the Tamil Tigers, video footage has emerged apparently showing government troops summarily executing Tamils.

Journalists for Democracy in Sri Lanka, which obtained the material, said it was filmed in January - when the international media were prevented by the Sri Lankan government from covering the conflict zone.

The Sri Lankan government launched a large scale military offensive in January capturing the Tamil Tiger held town of Kilinochchi. The army then steadily pushed the rebels into an small area of the north-east.

மனிதாபிமானப் பிரச்சினை ஒன்று உருவாகுவதைத் தவிர்க்குமாறும் போர்ப் பகுதியில் உள்ள ஆயிரக்கணக்கான மக்களுக்குத் தேவையான உதவிகள் சென்றடைவதற்கு வழிவகுக்குமாறும் அவசர கோரிக்கை விடுத்துள்ள அமெரிக்க அரச தலைவர் பராக் ஒபாமா, இந்த மனிதாபிமானப் பிரச்சினை தொடர்பாக உடனடி நடவடிக்கை எடுக்கப்படவில்லை என்றால் இது ஒரு பேரழிவாக மாற்றமடையும் எனவும் கடுமையாக எச்சரித்துள்ளார்.
இந்தப் பிரச்சினையுடன் சம்பந்தப்பட்ட அரசியல் விவகாரங்களை ஒருபுறத்தில் ஒதுக்கிவைத்துவிட்டு, போரில் அகப்பட்டுள்ள அப்பாவி ஆண்கள், பெண்கள், சிறுவர்களின் உயிர்களையிட்டுத்தான் நாம் முதலில் எமது கவனத்தைச் செலுத்த வேண்டும் எனவும் வெள்ளை மாளிகையில் நேற்று புதன்கிழமை ஊடகவியலாளர்கள் மத்தியில் உரையாற்றுகையில் அமெரிக்க அரச தலைவர் வலியுறுத்தினார்.

முல்லைத்தீவு மாவட்டத்தில் 'மக்களுக்கான பாதுகாப்பு வலயம்' எனப் பிரகடனப்படுத்தப்பட்டுள்ள பகுதி மீது சிறிலங்கா படையினர் தமது தாக்குதல்களைத் தீவிரப்படுத்தி, மருத்துவமனைகள், மக்கள் குடியிருப்புப் பகுதிகள் என்பன தொடர்ச்சியான எறிகணைத் தாக்குதலுக்குள்ளாகி ஆயிரக்கணக்கான மக்கள் கொல்லப்பட்டுவரும் ஒரு நிலையிலேயே அமெரிக்க அரச தலைவர் இந்த அவசர கோரிக்கையை முன்வைத்திருக்கின்றார்.

இங்கு ஊடகவியலாளர்கள் மத்தியில் உரையாற்றிய ஒபாமா மேலும் தெரிவித்ததாவது:

இலங்கையில் ஒரு மனிதாபிமானப் பிரச்சினை உருவாகியிருக்கின்றது என்பதை நீங்கள் அறிந்திருப்பீர்கள். போர்ப் பகுதியில் இருந்து அண்மைக்காலத்தில் கிடைத்த செய்திகள் மிகவும் கவலையளிப்பதாக இருக்கின்றது.

இப்பகுதியில் ஆயிரக்கணக்கான மக்கள் அங்கிருந்து வெளியேறுவதற்கு எந்தவிதமான வசதிகளும் இல்லாமல், உணவு, குடிநீர், மருந்து மற்றும் வதிவிட வசதிகள் எதுவும் இல்லாமல் அகப்பட்டுள்ளார்கள். இது பாரிய அவல நிலையைத் தோற்றுவித்திருப்பதுடன், ஆயிரக்கணக்கான மக்கள் இதனால் உயிரழிக்கும் நிலைமையும் ஏற்பட்டிருக்கின்றது.

இது தொடர்பில் உடனடியான நடவடிக்கை எடுக்கப்படவில்லை என்றால் இந்த மனிதாபிமானப் பிரச்சினை ஒரு பேரழிவாக மாற்றமடைந்துவிடும். இந்தப் பிரச்சினையுடன் சம்பந்தப்பட்ட அரசியல் விவகாரங்களை ஒருபுறத்தில் ஒதுக்கிவைத்துவிட்டு, போரில் அகப்பட்டுள்ள அப்பாவி ஆண்கள், பெண்கள், சிறுவர்களின் உயிர்களையிட்டுத்தான் நாம் முதலில் எமது கவனத்தைச் செலுத்த வேண்டிய தருணம் இப்போது வந்திருப்பதாகவே நான் கருதுகின்றேன்.

இந்நிலையில் விடுதலைப் புலிகள் தமது ஆயுதங்களைக் கீழே போட்டு விட்டு அப்பகுதியில் உள்ள மக்கள் வெளியே வருவதற்கு அனுமதிக்க வேண்டும் என நான் கேட்டுக்கொள்கின்றேன். பொதுமக்களை அவர்கள் பலவந்தமாககப் படைக்குத் திரட்டிக்கொள்வதும், பொதுமக்களை மனித கேடயங்களாகப் பயன்படுத்துவதும் ஏற்றுக்கொள்ள முடியாதவை. இவ்வாறான செயல்கள், அத்தகைய செயல்களில் ஈடுபடுபவர்கள் ஒதுக்கப்படுவதற்கே வழிசெய்யும்.

இந்த மனிதாபிமானப் பிரச்சினையை தவிர்ப்பதற்காக சிறிலங்கா அரசாங்கமும் பல நடவடிக்கைகளை மேற்கொள்ள வேண்டும் எனக் கேட்டுக்கொள்கின்றேன்.

முதலாவதாக - ஆயிரக்கணக்கான மக்களின் மரணங்களுக்கு காரணமாகவுள்ள எழுந்தமானமான எறிகணைத் தாக்குதல்களை சிறிலங்கா அரசாங்கம் நிறுத்திக்கொள்ள வேண்டும். இதில் பல மருத்துவமனைகளும் தாக்குதலுக்கு உள்ளாகியுள்ளன. அதேவேளையில் சிக்கலுக்கு உரிய பிரதேசத்தில் கனரக ஆயுதங்களைப் பயன்படுத்துவதில்லை என்ற தமது உறுதிமொழியை சிறிலங்கா அரசாங்கம் நடைமுறைப்படுத்த வேண்டும்.

இரண்டாவதாக - போர் இடம்பெறும் பகுதிக்கு ஐக்கிய நாடுகள் சபையின் மனிதாபிமானக் குழு ஒன்று செல்வதற்கும் அங்குள்ள மக்களின் உயிர்களைப் பாதுகாப்பதற்குத் தேவையான மனிதாபிமான உதவிகளை வழங்குவதற்கும் சிறிலங்கா அரசாங்கம் அனுமதியை வழங்க வேண்டும்.

மூன்றாவதாக - இடம்பெயர்ந்துள்ள சுமார் 1 லட்சத்து 90 ஆயிரம் மக்களையும் பார்வையிடுவதற்கும் அவர்களுக்குத் தேவையான மேலதிக உதவிகளை வழங்குவதற்கும் ஐ.நா.வையும் அனைத்துலக செஞ்சிலுவைச் சங்கத்தையும் சிறிலங்கா அரசாங்கம் அனுமதிக்க வேண்டும்.

இந்த வேளையில் அனைத்துலக சமூகத்துடன் இணைந்து செயற்பட்டு அங்குள்ள மக்களுக்கு உதவுவதற்கு அமெரிக்கா தயாராகவிருக்கின்றது. இதில் தாமதம் கூடாது என நான் நினைக்கின்றேன். இந்த சந்தர்ப்பத்தில் மேலும் மனிதாபிமானப் பிரச்சினைகள் ஏற்படுவதைத் தவிர்ப்பதற்காக நாம் அனைவரும் இணைந்து செயற்பட வேண்டியது அவசியம்.

இதற்கு மேலாக சிறிலங்கா அரசாங்கமானது அந்த நாட்டில் உள்ள அனைத்து மக்களினதும் கெளரவத்தைப் பாதுகாக்கக்கூடியவகையிலான இறுதித் தீர்வு ஒன்றை முன்வைக்க வேண்டும் எனவும் கேட்டுக்கொள்கின்றேன்.

மேலும் மரணங்கள் இடம்பெறுவது அந்த நாட்டு மக்கள் விரும்பும் சமாதானத்தை அடைவதற்குத் தடையாகவே இருக்கும் என்பதையும் தெரிவித்துக்கொள்ள விரும்புகின்றேன் என்றார் அவர்.
